The Zoning Board of Adjustment (ZBOA) consists of 5 citizen volunteers from within the Town’s corporate limits and 1 from the ETJ that hold quasi-judicial hearings, or evidentiary hearings, and make decisions based solely on the written and oral evidence presented.
ZBOA heard and approved one case to grant a variance to allow a seven foot encroachment into a setback from a riparian buffer. Two other cases that were submitted were withdrawn prior to public hearing. One case appealing an administrative decision is on hold pending direction from the applicant regarding the boundaries of the property affected by the appeal.
The Town of Cary Planning Staff conducted nine pre-application conferences with citizens who contemplated submitting variance requests for encroachments to building setbacks or sign sizes. All but one of the applicants elected to seek an alternate method of resolving their issue.
