BACKGROUND:  Mr. Morris Andrews has requested an amendment to the Joint Resolution of the Towns of Apex and Cary Establishing Jurisdictional Boundaries to allow him to address a failing well by using the Town of Apex’s water system.  Mr. Andrews’s house and one-acre parcel is located at 1324 Holt Road and is on the boundary of the agreed upon limits of the towns’ utility service areas.  Apex has a water line that is adjacent to the property.  Cary’s water line is approximately 700 feet away.  Staff believes this extension from the Cary’s water line is reasonable and that the applicant should extend the water line.  An amendment to the boundary line may lead to additional amendments for other properties along this line which would jeopardize the integrity of the boundary.

 

Fiscal Impact:  If the agreement is amended, then this property and potentially others may be allowed to connect to Apex’s utility system and be annexed by Apex which would result in a lost of customers and revenue for the Town.

 

Staff Recommendation:  Staff recommends denial of the request to amend the Joint Resolution of the Towns of Apex and Cary Establishing Jurisdictional Boundaries.  The property owner is permitted to extend the Cary water line to his property per Town policy.
