Request for Road Improvement Waiver – Kilmayne Office Park (EN08-096)
Consideration of approving a request for waiver of thoroughfare improvement requirements associated with the Kilmayne Office Park Mixed Use Sketch Plan (07‑MU-06)

Jerry Turner and Associates, Inc., on behalf of their client, Northstar Partners, LLC, is requesting a waiver from thoroughfare improvements associated with the Kilmayne Office Park Mixed Use Sketch Plan, located in the northwest and southwest intersection quadrants of Kilmayne Drive and SE Maynard Road. Per Town ordinance, when any development plan is submitted for review and approval by the Town, the developer must dedicate right-of-way and construct any road improvements necessary to meet the Town’s current Thoroughfare Plan. The developer is responsible for half-street improvements and right-of-way dedication along the entire property frontage.
SE Maynard Road is required to have an ultimate 4-lane landscaped median cross section (two through lanes in each direction; inside lanes 12’ wide; outside lanes14’ wide). The Town recently widened SE Maynard Road to a 5-lane undivided road along the Kilmayne Office Park frontage.
The applicant is requesting a waiver from the thoroughfare widening improvements of SE Maynard Road. The additional right-of-way for the ultimate 4-lane divided section will be dedicated. The thoroughfare waiver request is based on the following provided by the applicant:
1. SE Maynard Road has just recently been improved to its current section.
2. It would be in the best interest of the Town to make any additional improvements at the time they are warranted along the entire portion of Maynard Road and not just in front of our site.
3. Town Council approved a waiver request for Greenwood Baptist Church from thoroughfare improvements along SE Maynard Road.
Fiscal Impact: If the road improvements become the Town’s responsibility due to a waiver being granted, the SE Maynard road improvements would cost the Town approximately $45,000.
Staff Recommendation: Staff recommends that Town Council require the right-of-way dedication, but grant a waiver from further widening along SE Maynard Road.
