Petition for Water and Sewer Service – 2416 Stephens Road (EN09-030)

This resident along Stephens Road has petitioned for water and sewer service in accordance with Policy Statement 23, Water and Wastewater System Extension and Connection Policy. The property listed on the petition for water and sewer service is located within the corporate limits of the Town of Cary along Stephens Road as shown on the attached map. This property was annexed during the 2003 Town-initiated annexation, which became effective on June 30, 2003.
Policy 23 requires that all sufficient petitions for water and sewer service shall consist of 50% or more of the property owners who own property adjacent to 50% or more of the frontage along the proposed water and sewer alignment. This is the only property along the private road, located at the end of Stephens Road, requesting water and sewer be extended. Property owners at the other end of Stephens Road petitioned the Town of Cary for the extension of water and sewer earlier this year. The petition was approved in Staff Report EN09-001. At that time, none of the remaining properties along Stephens Road signed the petition. Since only one property is petitioning for water and sewer at this time, it will not meet the requirements of Policy Statement 23.
As a condition of Policy 23, the petitioning property owner has agreed to pay their corresponding water and sewer development fees. Since all of the properties in the petition area along Stephens Road were annexed during the 2003 annexation, the same fee schedules utilized by the other 2003 annexation communities, including Hillsdale Forest, Triangle Forest and Summerwinds, would be utilized, upon approval of their petition. As a result, no connection fees would be charged to those petitioning property owners in the petition area along Stephens Road who pay their development fees on schedule.
Fiscal Impact: Pending approval of the petition submitted by the property owner along Stephens Road, funding would be provided by the water and sewer accounts created to fund petition initiated water and sewer extension projects. Project accounts, SW1087 and WT1094, were created during the 2003 fiscal year to fund water and sewer extensions to serve established residential communities annexed during 2003 and other communities as necessary inside the Town limits that do not have access to municipal water and sewer service. Project number WT1094 currently has a balance of $1,683,918.76 and project number SW1087 has a balance of $2,246,458.32 to fund new petition initiated projects. In order to establish project funding for the proposed Stephens Road water and sewer extensions, separate water and sewer project accounts would have to be created.
Staff Recommendation: Staff recommends in favor of approving the petition submitted by the resident along Stephens Road. Staff further recommends incorporating this into the previously approved Stephens Road Water and Sewer Extension Project, SW5015 and WT5015. The funding would be added to the accounts as follows, to fund the water and sewer system construction.
Staff recommends adding $35,000.00 to project number SW5015, Stephens Road – Phase 1 Sewer Extension, to fund the additional sewer construction. Staff recommends transferring the $35,000.00 from the host account SW1087, into the construction budget for SW1015. This transfer will reduce the remaining balance of SW1087 to $2,211,458.32, to fund new petition-initiated sewer projects.
Staff recommends adding $35,000.00 to project number WT5015, Stephens Road Water Extension, to fund the additional water construction. Staff recommends transferring $35,000.00 from the host account WT1094, into the construction budget for WT1015. This transfer will reduce the remaining balance of WT1094 to $1,649,918.76, to fund new petition-initiated water projects.
