NCDOT Request to Close a Portion of Turner Creek Road (EN07‑011)
Consideration of an NCDOT request to close a portion of Turner Creek Road beyond Turner Creek Elementary School

NCDOT has received a request to close a portion of Turner Creek Road as it traverses in a westward direction past Turner Creek Elementary School.  NCDOT has requested concurrence from the Town of Cary in this closing.

Since the development initiating the request will be within the Town limits and the road constructed in its place will be a Town-maintained street, NCDOT indicated that it would abandon maintenance of Turner Creek Road in deference to the Town absorbing this roadway as a town street.  NCDOT is proposing turning over all of Turner Creek Road from its intersection with NC55 to the end of the right of way (approximately 3100 feet).  The Town of Cary will in turn schedule a public hearing to consider closing that portion of Turner Creek Road from the western property line of Turner Creek Road Elementary School westward to the end of NCDOT maintenance in conjunction with the dedication of a realigned right of way in this same area.  No access to properties will be denied or abridged by this closing.  

Fiscal Impact:  There is no fiscal impact of this right of way closing request.

Staff Recommendation:  Staff recommends the committee approve this and forward it to the Town Council for concurrence with authority for the Mayor to execute the attached resolution supporting NCDOT in their closing of this R/W.

RESOLUTION FOR SUPPORT OF

RIGHT OF WAY CLOSING

A RESOLUTION APPROVING THE REQUEST TO NCDOT TO CLOSE A PORTION OF TURNER CREEK ROAD.

            WHEREAS, the developers of property along Turner Creek Road have made a request to the NCDOT to close a portion of the road; and

            WHEREAS, the NCDOT has requested concurrence of this proposed right of way closing by the Town of Cary, and

            WHEREAS, the Town of Cary joins in supporting this right of way closing request;

            NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Cary meeting in regular session that:

            THE TOWN OF CARY SUPPORTS closing that portion of Turner Creek Road right of way from the western property line of Turner Creek Road Elementary school westward to the end of NCDOT maintenance and will work to ensure that that no access to private property will be denied or abridged by this closing.

            Upon motion duly made by Council member _________________________, and duly seconded by Council member ___________________, the above resolution was duly adopted by the Town Council at the regular meeting held on the ____ day of _______________, 2006, in the Town Hall.
