SW Maynard Road Widening Project Condemnation Resolutions (EN07‑002)
Consideration of approval of condemnation resolutions related to securing necessary easements for the SW Maynard Road Widening Project

Staff has been working with property owners to secure rights of way and other easements necessary for the roadway improvements associated with the widening of the SW Maynard Road Widening project.  For this project, 85 parcels are affected, with about 255 easements required on those parcels. Negotiations are ongoing and progress is being made toward reaching amicable solutions.  In some of the cases below, Staff is continuing to pull together information for the property owners to facilitate their understanding of the project.  In others, several property owners have sought input into minor design changes that are being investigated.  The owner of one of the parcels is reviewing a total purchase by the Town.  In all cases, Staff is continuing to work with the property owners to reach an amicable settlement.

 

To minimize disruption to the construction schedule, Staff proposes approval of condemnation resolutions.  Staff will continue to work with property owners to negotiate a mutually agreeable settlement.  Condemnation Resolutions will be provided to the Town Council prior to the August 10, 2006 meeting.

Fiscal Impact:  The Town will incur the cost of eminent domain proceedings which are estimated to be initially between $1,600 and $5,000 per property and will be paid from existing and available funding within the SW Maynard Road Widening Project (ST1005).

 

Staff Recommendation:  Staff recommends approval of Resolutions Authorizing Condemnation.
