DOWNTOWN PARKING LOT

Purpose
To adopt an official policy for use by the Downtown Parking Lot, a municipal parking lot that is owned by the Town of Cary.
Coverage
This policy, upon adoption by the Town Council, shall be applicable to the use of the Downtown Parking Lot until such time that the policy statement is altered, modified or rescinded by the Town Council.
Policy
The Town Council of the Town of Cary hereby establishes the following policy:
1. Facility: The Downtown Parking Lot is located in downtown Cary and is bounded by the CSX Railroad, the Norfolk Southern Railroad, North Harrison Avenue and North Academy Street.
2. General Usage: The general usage of the facility is to provide a municipal parking area for visitors and employees in the downtown area and to serve as a park and ride lot for commuting. Row Two (five spaces) of the parking lot will be reserved parking for Town of Cary Fire Department vehicles.
3. Special Usage: The Downtown Parking Lot shall be available to special usage as outlined below:
a. The hours of special use shall be from 7:00 p.m. to 11:00 p.m. on weekdays; from 3:00 p.m. to 11:00 p.m. on Saturdays; and from 1:00 p.m. to 9:00 p.m. on Sundays.
b. Reservations for special usage will not be accepted more than 90 days in advance. All special use reservations must be submitted to the Department of Planning and Development on a "Temporary Use Permit Application" as outlined in the Cary Unified Development Ordinance.
c. Fees for special usage shall be those as adopted in the Annual Budget of the Town of Cary.
d. Cancellation: The Town of Cary reserves the right to cancel any special use permit for the Downtown Parking Lot. Cancellation notice will be issued as far in advance as possible. All rental fees will be refunded in full.
e. Rules for special usage: All groups and individuals receiving a permit for a special event in the Downtown Parking Lot shall adhere to the following rules:
(1) All temporary structures shall be erected in a manner which will not damage the parking lot pavement, vegetation, curb and gutter or pavement markings.
(2) On site cooking is prohibited.
(3) Consumption of alcoholic beverages is prohibited.
(4) The erection of temporary power poles and outlets is prohibited.
(5) All trash, garbage, litter, etc., must be removed at the end of the special use.
(6) All personal equipment must be removed from the facility at the end of the special usage.
(7) All conditions set forth in the "Temporary Use Permit" must be adhered to.
4. The Town Council reserves the right to grant permission for non-parking use of the parking lot in accordance with uses allowed under the "Temporary Use Ordinance."
