SCHEDULE FOR RECEIVING INFORMATION REGARDING REZONING AND PUD APPLICATIONS

Purpose

 

The Town Council must have information related to rezoning requests and PUD applications submitted to staff in sufficient time for staff to be able to review and make a recommendation to the Town Council about the relation of the information to Town goals, policies and ordinances.

 

Coverage

 

The process for considering rezoning requests and PUD applications in the Town of Cary requires four steps:

 

1. Submittal to and review by staff prior to public hearing;

2. A public hearing before Town Council and the Planning and Zoning Board to receive public comment prior to consideration by the Planning and Zoning Board;

3. Review and recommendation by the Planning and Zoning Board; and

4. Town Council decision.

 

The Unified Development Ordinance of the Town of Cary sets out a schedule for the review of requests for zoning decisions and approvals of planned unit developments to meet the objectives of the review process. In addition to that schedule, the Town Council requires new information after the initial submittal related to rezoning requests and PUD applications be submitted on the following schedule.

 

The Town Council and Planning Board will consider new information related to these requests only if that information is submitted to staff one week prior to the Planning and Zoning Board meeting or one week prior to the Town Council meeting at which the request is scheduled for consideration. This time is required in order for staff, the Planning and Zoning Board and Town Council to have time to adequately review the information and its relation to the policies, goals and ordinances of the Town of Cary.

 

If the applicant develops new information relevant to rezoning requests or PUD applications including new conditions, changes in conditions, traffic studies, flood and erosion control information, or other significant information between the public hearing and Planning and Zoning Board meeting or between the Planning and Zoning Board meeting and the Town Council meeting at which action is scheduled and cannot submit that information to the planning staff one week prior to consideration, the rezoning request or PUD application will (1) proceed without the new information being considered; (2) be deferred to the Planning and Zoning Board or Town council meeting the following month; or (3) be referred back to the Planning and Zoning Board by Town Council.
