BOND PARK FACILITIES

Purpose

 

To adopt an official policy for the rental of Town of Cary public recreation facilities at Bond Park administered by the Parks Recreation and Cultural Resources Department.

 

Coverage

 

This policy, upon adoption by the Town Council, shall be applicable to the rental and use of Town owned areas until such time that the policy statement is altered, modified, or rescinded by the Town Council.

 

Policy

 

The Town Council of the Town of Cary hereby establishes the following policy:

 

1.         Facilities

 

Sertoma Amphitheatre:  A public, open-air, outdoor theatre with seating for 350 persons and stage.  Rental of Sertoma Amphitheatre includes concurrent reservation of the Kiwanis Picnic Shelter.

 

2.         Scheduling - List of Priority

 

a.         Town sponsored programs and activities have first priority for use of the facilities.

 

b.         Programs/activities planned and directed by groups sponsored or co-sponsored by the Town.

 

c.         Private, non-profit organizations, individual, etc., first come, first serve basis, not more than 3 months prior to scheduled usage date.

 

3.         Reservation

 

a.                  Reservations for the Sertoma Amphitheatre are available to Cary residents only.

 

b.                  Person making reservation is held responsible for any and all damage or misuse of facilities.  No reservation will be accepted unless “Application for Use” is accompanied by reservation/damage deposit payable to Town of Cary .

 

c.                  Payment of Rental Fees:  Rental fees must be paid in full no later than 30 days prior to the date of use.  Rental fees are payable at any Community Center office during normal operating hours.  Late rental payment will result in a 10 percent late rental surcharge.

 

4.         Cancellation

 

a.         The Cary Parks Recreation and Cultural Resources Department reserves the right to make cancellations at any time.  Cancellation notices will be issued as far in advance as possible.  All reservation/damage deposits and rental fees will be returned in full if cancellation is initiated by the Parks Recreation and Cultural Resources Department.

 

b.         Cancellation may be initiated by party making reservation up to 30 days prior to scheduled use date without liability.  All cancellation notices must be submitted in writing to a Community Center Supervisor.  Failure to notify the Community Center Supervisor of a cancellation at least 30 days prior to the reservation date will result in forfeiture of reservation/damage deposit.

 

c.         No cancellations will be accepted within five working days of scheduled usage.  Party making cancellation will be liable for payment of rental fees and other charges in full.

 

5.         Rules and Regulations

 

a.                  Party signing “Application for Use” is held responsible for any and all damage or misuse of facilities.

 

b.                  Non-profit organizations conducting fundraising events must receive approval prior to reservations.  Upon request of the Director of Parks Recreation and Cultural Resources, user will be required to furnish proof as a bona fide non-profit organization.  No other groups or individuals may use the facility for any type of profit making purpose.

 

c.         Parents or guardians must sign for anyone under 21 years of age and youth groups requesting use of the facility and must assure adequate adult supervision.

 

d.         Upon request of Director of Parks Recreation and Cultural Resources, police security will be required (at the user’s expense) before a reservation request is approved.

 

e.         Groups using the fireplace and cooking facilities must provide their own firewood/charcoal and dispose of all ashes, etc., in metal can provided at site.  Fireplace and cooking facility must be left clean.  (Note:  When the Cary Fire Department issues a burning ban, fires of any kind are prohibited at Bond Park.)

 

f.          Private ticket sales and collections of any type of funds for performances or uses of the amphitheatre are prohibited.

 

g.         Loud music, performances, and uses that generate sound disrupting the tranquility of the park are prohibited.

 

h.         Possession and consumption of alcoholic beverages is prohibited in Bond Park.

 

i.          All trash, garbage, litter, etc., must be placed in all trash containers provided; all tables and benches must be left in same area as found.  All lights must be out prior to leaving facility.  (Note:  Security lights remain on.)

 

j.          All groups using the facility must remove all equipment, etc., and be out of Bond Park 30 minutes prior to posted park closing time.

 

k.                  Failure to comply with the above rules and regulations will result in forfeiture of reservation/damage deposit, payment of additional damage fees, if applicable, and loss of privileges for use of the facility.

 

6.         Fees

 

Fees for use of the Bond Park Facilities shall be those as adopted in the annual budget of the Town of Cary .
