Addendum to Memorandum of Agreement between the North Carolina Department of Environment and Natural Resources and the Town of Cary Regarding the Use of its (the Town’s) Secondary and Cumulative Impact Master Mitigation Plan This Addendum to the Memorandum of Agreement (MOA) is made and entered into on the date herein below last written by and between the Town of Cary (hereinafter “TOWN”) and the NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES (hereinafter “DENR”), collectively referred to hereinafter as the “Parties”. WHEREAS, the MOA requires the TOWN to submit a report to DENR’s Environmental Review Coordinator (ERC) regarding TOWN actions that affect the Secondary and Cumulative Impacts Master Mitigation Plan (PLAN) on a biennial basis with the first report due one year from the effective date of this MOA; WHEREAS, the TOWN holds an NPDES Phase II stormwater permit which requires an annual report to DENR; WHEREAS, the TOWN will compile much of the same information for the NPDES Phase II stormwater report and the biennial report required under their MOA; THEREFORE, the Parties hereby enter into this Addendum to the MOA to better synchronize the reporting requirements. This Addendum only addresses the biennial report deadline; all other provisions in the original MOA remain in effect.
