Family Medical Leave Act (FMLA)
What is the FMLA?- The federal Family and Medical Leave Act of 1993 (FMLA) allows a qualified employee with a qualifying situation to take up to 12 weeks (or 480 hours) of unpaid leave in a 12-month period. The Department of Labor administers this law.
- A qualifying employee under the FMLA is an employee who has worked at least 12 months for the employer; who has worked at least 1,250 hours for the employer in the 12 months preceding the leave date; and who has a qualifying situation.
- A qualifying situation under the FMLA is the birth of a child; the adoption or foster care of a child; the employee's own serious health condition; or the serious health condition of the employee's spouse, parent or child.
- For a medical condition to qualify under the FMLA, it must meet the Department of Labor's definition of a serious health condition, as defined in the law.
