TOWN COUNCIL PUBLIC HEARINGS

 

The public will take notice that the Cary Town Council will meet in regular session on June 25, 2009 at 6:30 p.m. in Town Hall Council Chambers, 316 N. Academy St., Cary, NC to conduct public hearings on the following items.

RESOLUTION OF INTENT

STREET CLOSING

 

A RESOLUTION DECLARING THE INTENTION OF THE TOWN COUNCIL TO CONSIDER THE CLOSING OF a portion of right of way of Airgate Drive in Airport Gateway Subdivision as described on the attached Exhibit A (‘Street’).

               WHEREAS, G.S. 160A-299 authorizes the Town Council of the Town of Cary to close public streets; and

 

               WHEREAS, G.S. 160A-299 requires that certain procedures be followed including the calling of a public hearing, and the Town Council of the Town of Cary considers it advisable to conduct a public hearing for the purpose of giving consideration to the closing of the Street.

 

              NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Cary meeting in regular session that:

 

              (1)  A public hearing will be held at 6:30 p.m. on the 25th day of June, 2009 in the Cary Town Hall to consider adopting an order closing portions of the above-referenced street(s).

 

              (2)  The Town Clerk is hereby directed to publish this Resolution of Intent with Exhibit A once a week for four successive weeks prior to the public hearing in The Cary News.

 

              (3)  The Town Clerk is further directed to transmit by certified mail to all owners of property adjoining that portion of said street as shown in the Wake County tax records a copy of this Resolution of Intent with Exhibit A;

 

              (4)  The Engineering Department is directed to prominently post a notice of the closing and public hearing in at least two places along said street.  If the street is under the authority and control of the Department of Transportation, the Engineering Department shall mail a copy of this Resolution of Intent to the Department of Transportation.

 

              Upon motion duly made by Council member Gale Adcock, and duly seconded by Council member Ervin Portman, the above resolution was duly adopted by the Town Council at the regular meeting held on the 14th day of May 2009, in the Town Hall.

PORTION OF AIRGATE DRIVE TO BE CLOSED

 

Being the 32.5 R/W dedicated by record plat recorded in Book of Maps 2000 PG 803 and more particularly described as follows:

 

BEGINNING at a point a corner with Shaunak Patel (DB 12894, PG 2762) said corner located S 80°57'02" E 159.59' from a point located in the SE margin of Triple Oak Road a public right of way said point being a common corner with the aforementioned Shaunak Patel and V Five LLC DB 7341 PG 518 as shown on the aforementioned plat; thence with the western line of Patel tract and eastern line of this subject parcel S 06°26'54" E 400.05’ to a point in the right of way of AIRGATE DRIVE a public right of way; thence with a curve to the left an arc distance of 33.67’ having a radius of 55.00’ with a chord of S 72°13'25" W 33.15’ to a point a corner with V Five LLC (DB 7341, PG 518); thence with the eastern line of said tract and the western line of this subject parcel N 06°26'54" W 449.62' to a point in the line with aforementioned Patel; thence with his line S 80°57'02" E 33.73’ to the BEGINNING containing 14,231 square feet according to a map aby Aiken & Yelle Associates, PA, entitled "Right of Way Abandonment, Property of Town of Cary, BM 200, PG 803", dated 4/22/09.

            Sealed proposals will be received by the Town of Cary at the office of the Public Works and Utilities Department, William H. Garmon Operations Center, 400 James Jackson Avenue, Cary, North Carolina until Thursday, July 16, 2009 at 2:00 p.m. and thereafter immediately opened and read publicly for the furnishing of materials, labor, and equipment for the construction of the “2009 Sewer Rehabilitation Project, Project No(s).  SW1141 and SW1167.  Approximate quantities involved are as follows:

 

±        35,000-LF of sewer cleaning and television inspection of existing 8-inch diameter sewer mains.

±        35,000-LF of cured-in-place pipe lining installation in existing 8-inch diameter sewer mains.

±        420 reconnections of active service laterals to new cured-in-place pipe.

±        700 vertical feet of manhole rehabilitation

 

            Plans, Specifications and Contract documents may be seen at the office of the Director of Public Works and Utilities, William H. Garmon Operations Center; the Associated General Contractors, Raleigh office; McGraw-Hill Construction Dodge, Morrisville office; the North Carolina Institute of Minority Economic Development, Durham office; and the Cary office of CDC News; after June 22, 2009.

 

            Copies of Plans, Specifications and Contract documents may be obtained after June 22, 2009 at the office of the Public Works and Utilities Department, William H. Garmon Operations Center , 400 James Jackson Avenue , Cary , North Carolina 27513 upon non-refundable payment of $25.00 per set in cash or check.  A postage and handling charge of $5.00 will be added for any items which are mailed.  Please direct all inquiries to Lynn Brilz, P.E. at 919-460-1047.

 

            Contractors offering a proposal on this project must be licensed to do the specified type of contracting in the State of North Carolina .   A Town of Cary Privilege License in accordance with North Carolina General Statutes is required for award of the project.  All bids must include a non-collusive affidavit.

 

            Each proposal shall be accompanied by a bid deposit in the amount of not less than five percent (5%) of the amount of the bid in the form and subject to the conditions provided in the Instruction to Bidders.

 

            The Town of Cary reserves the right to reject any or all proposals.

COMBINED GIVING CAMPAIGN - The Town of Cary will accept applications for participation in the Town’s 2009 Combined Campaign (Employee Payroll Deduction Giving) from qualified organizations until 5 p.m. , Monday, July 6, 2009  (A qualified organization is a non-profit tax-exempt charitable organization that holds and maintains a currently valid designation by the Internal Revenue Service (IRS) as a 501(c)(3) organization and is eligible to receive tax-deductible contributions under Section 170 of the Internal Revenue Code and any relevant laws of the State of North Carolina).  Complete information on participation criteria is available by visiting the Town of Cary Human Resources Department at 316 N.
