Process for starting the
one year WARRANTY routine acceptance of public improvements
Routine acceptance to start the one year warranty:
All improvements intended for public maintenance are eligible
for acceptance by the Town of Cary following the procedures
outlined below.
- After the installation of the
improvements in accordance with Town Council approved
plans and Town Standard Specifications and Details, the
Owner/Developer or designees shall contact the
Engineering Department and schedule a punch list to
determine what items must be completed prior to the start
of the one year warranty and routine maintenance period.
- The Engineering Department will
accept the improvements or respond with a punch list
within fourteen (14) days of the request.
- The Owner/Developer or designee must
complete all items indicated on the punch list, and any
additional items noted within sixty (60) days or the
punch list will be void. The Owner/Developer or designee
must then request another inspection to verify completion
of the punch list.
Typical items included in a
punch list are:
- Submittals of as-builts.
- Verification that development fees
have been paid.
- Verification that all rights of way
and easements have been dedicated by recording through
Wake County Register of Deeds.
- Verification that engineers
certifications have been issued in accordance with the
utility extension permits.
- Final acceptance of all fire hydrants.
- Repair of all deficient curb and
gutter, sidewalk, streets, storm drainage, utilities and
erosion control.
- Submittal of the Financial Guarantee bond is required as indicated below. The
bond guarantees that the public improvements will be
accepted following the acceptance procedure.
For Site Plan Projects or
Infrastructure Only Related Projects:
The Financial Guarantee bond must be submitted prior to
acceptance of the improvements or prior to the issuance of
certificate of occupancies.
For Subdivision Projects:
The Financial Guarantee bond may be submitted at anytime.
However, it is required to be in place prior to 50% of the
building permits/certificate of occupancies being issued prior to
total acceptance by the Town.
There is an alternative to completing 100% of the construction and punch lists in order to achieve acceptance for routine maintenance and the beginning of the one year warranty period. The alternative and process is listed below:
The Owner/Developer may request routine
acceptance and the one year warranty to begin without the final
one inch lift of asphalt being installed. The following
requirements are in addition to alternate Number 1 listed above:
- The Owner/Developer or designer may
request with the pavement design prior to plan approval
by the Town, to include one half inch asphalt in addition
to the present design section (example: for a designed
pavement section of 8" ABC and 2" I-2 asphalt,
the new pavement design would be 8" ABC 1-1/2",
I-2 asphalt 1". I-2 asphalt).
- All valve boxes, sanitary sewer
manholes and storm drain junction boxes must be adjusted
flushed with the riding surface..
- A completion bond for the final one
inch asphalt, valve and manhole adjustments, must be
submitted to guarantee completion of the remaining work.
When this option is chosen, the Developer
would be responsible for two separate bond guarantees, one for
completion of work and one for the financial guarantee that all
work will be acceptable by the Town for total maintenance at the
conclusion of the warranty period.
Note: Bonding requirements (for
guaranteeing completion) or (in accordance with the code) may be
submitted as a letter of credit drawn on a North Carolina bank or cash bond and must remain in place until all
work has been completed and/or accepted for total maintenance by
the Town of Cary.
