LAND USE CONDITIONS
Tract A
- All multi-family uses shall be permitted
- Buildings shall be architecturally compatible
throughout the tract and with Tract B.
- Maximum number of units shall be 148.
- Buildings located along Piney Plains Road shall not exceed two stories in height.
- Open space (2.75) acres will be located along Tryon Road as indicated on the Master Land Use Plan. An
entrance drive, water and sewer outfall easement will be permitted in and
throughout this open space.
- Along Piney Plaines Road the 30’ streetscape buffer will be undisturbed
except for the removal of noxious plants and weeds.
- Two recreational facilities totaling +1.8
acres, including pools, cabanas and associated parking shall be located in
this tract. See illustrative plan for location.
- Internal sidewalks will be connected to Town of Cary Greenway located around the lake and shall connect with
public sidewalk along Piney Plains and Tryon Road.
- Buffers shall be as indicated on the Master Land
Use Plan.
- A sewer outfall line and easement will be placed
in the Town of Cary 50’ Greenway located on the lake continuous to
this tract.
- Storm drainage piping will be permitted through
the Town of Cary
Greenway.
Tract B
- All multi-family uses shall be permitted.
- Buildings shall be architecturally compatible
throughout the tract, and with Tract A.
- Along the northern boundary will be a 30’
greenway easement.
- Maximum number of units shall be 652.
- A passive park of + ˝ acre will be located
at the end of the entrance from Piney Plains Road, behind the proposed units. See illustrative
plan for location.
- A passive open space park of + ˝ acre will
be placed in front of units located on the lake. This will also be a tree
save area. See illustrative plan for location.
- Buffers shall be as indicated on the Master Land
Use Plan and shall be planted as per Cary’s U.D.O.
- Internal sidewalks will be connected to Town of Cary Greenway around the lake and shall connect with public
sidewalk along Piney Plains and Tryon Road.
- A sewer outfall line and easement will be placed in
the Town of Cary 50’ and 100’ greenway located on the lake and
creek continuous to this tract.
- Storm drainage piping will be permitted through
Town of Cary
Greenway.
Tract C
- Buffers are as indicated on the Master Land Use
Plan.
- Internal walkways will be connected to Town of Cary Greenway around lake and will also connect with public
sidewalk along new collector street.
- Maximum number of units shall be 125.
- A sewer outfall line and easement will be placed
in the Town of Cary 50’ Greenway located on the lake continuous to
this tract.
- Storm drainage piping will be permitted through
Town of Cary
Greenway.
- A sewer lateral line will be permitted through
Town of Cary
Greenway to
connect from Tract C to the proposed sewer outfall line.
- At the time of site plan approval the developer
will work with the Town of Cary to create a terminus of Yates Mill Pond Road extension as illustrated on the Southeast
Gateway Plan.
Tract D
The owner will convey to the
town a deed for the parkland as indicated on the Master Land Use Plan. This
conveyance will be made after construction drawing site plan approval has been
granted by the Town of Cary for the 800 units located on Tracts A &B.
General Conditions
- A uniform sign plan will be submitted to the Town
for approval when the first development plan is submitted for any of the
three multi-family tracts.
- The existing lake regardless of ownership will be
allowed to be used as a structure to fulfill the Swift Creek Watershed
Management Requirements as it relates to water quality and storm water
impoundment.
- Any required dam upgrades to meet dam safety
requirements and Swift Creek Management Plan Requirements will be made by
the developer of this P.U.D.
- If the developer develops Tract C prior to the
Park construction it will be the developer’s responsibility to construct
the north-south collector street from Tryon Road to the northern boundary line.
- Access points indicated on the plan are schematic
in nature and will be determined at the time of site plan approval.
- The internal pedestrian circulation system for
all tracts will connect with Town of Cary Greenway and perimeter public sidewalks.
- When any site plans for Macedonia Village are submitted, building footprints, parking
locations, sidewalks, plantings and other built features may vary from the
illustrative plan depending on specific needs. The concept shown shall be
maintained. Changes may occur as per 5.5.13 change to approved Master Land
Use Plans, Cary U.D.O.
- Tracts A, B and C will include fully connected
sidewalk and/or pedestrian path system linking all buildings and
recreation areas. The specific locations of paths/sidewalks will be
determined and identified at the time of site plan.
- Lake and stream buffers shall remain undisturbed with the exception of
the construction of the greenway and utility lines.
- All road widening along the PUD property frontage
on Tryon
Road
and Piney
Plains Road will be constructed in Phase I to include:
a) adding exclusive left turn lanes on the eastbound and
westbound approaches of Tryon Road at the Piney Plains intersection.
b) adding an exclusive southbound right turn lane on Piney Plains Road at the Tryon Road/Piney Plains Road intersection.
11. The Greenways depicted on Sheet 6, Master Land
Use Plan, will be built by the Town
of Cary.
