This request is to allow a portion of the open space area to be removed from dedication and recombined with a single-family lot.

Analysis:

This rezoning allows property that is currently included within the open space of the Preston PDD to be removed from dedication and recombined with an existing single family lot to allow additional room for a driveway associated with a garage. The proposed garage complies with all setback requirements associated with the existing parcel prior to the addition of this additional area. The additional acreage to be recombined with the single-family parcel will allow the driveway as configured to comply with all Town Standards. The removal of this property from open space dedication will have a negligible impact on the open space of the development. This development will have over 262 acres of opens space after this 4555 square foot parcel is removed from dedication.

Pros: This request meets all Town of Cary requirements.

STAFF RECOMMENDATION:

Staff recommends approval.

PLANNING AND ZONING BOARD RECOMMENDATION:

Don Hyatt made a motion to forward to Council for approval, which was seconded by Carla Sadtler. The board voted 8 to 1 with Paul Broderick having the dissenting vote.

TOWN COUNCIL DECISION

Approved.
