FINAL CONDITIONS:
1. Thirty-foot (30) landscape buffer shall
be established along Lochmere Drive. Thirty-three (33) foot wide buffer
will be established along Kildaire Farm Road. These buffers will consist
of a combination of plant material and low berming to provide a visual
screen of adjacent parking areas and will be in harmony with the existing
landscape theme on the corner of Lochmere Drive and Kildaire Farm Road.
2. A twenty-five (25) foot undisturbed
buffer shall be established along the northeastern property boundary
adjacent to the Lochmere Association Greenway Area.
3. A twenty-foot (20) greenway easement
shall be preserved along the southeastern and southern boundaries adjacent
to the Lochmere Golf Course.
4. The maximum building height will be two
stories or not more than thirty-five (35) feet. Building height shall be
determined by using the average elevation of the topography along the
front of the proposed building.
5. Site lighting shall be provided as
required for the safety and security of the user. Accent lights will be
used around the building perimeter and area lights will be provided in the
parking lot to supplement existing street lighting from Lochmere Drive and
Kildaire Farm Road. Area lights will use cutoff fixtures to eliminate
nuisance glare and minimize light spill over to adjacent residential
properties. Site lighting shall comply with minimum Town of Cary
requirements. The maximum height of the light post shall be twenty (20)
feet, and fixtures shall not exceed two hundred (200) watts.
6. Developer shall submit site lighting
plan to Lochbain Homeowners for review and comment. This shall be done
prior to submittal of the site plan to the Town for review. At the time of
site plan submittal to the Town, the owner will provide written
documentation that this has been done.
7. The parking area shall be screened from
adjacent roadways and residential areas in Hampton Park using twenty-four
inch tall, evergreen plant material with a minimum mature height of four
(4) feet.7. The land use of this site
is to be designated Mixed Commercial Uses (Restaurants, Retail Stores and
Offices). Excluded uses are:
- Drive thru or to-go only uses
- Automotive supply stores
- Outside building perimeter merchandise
display (e.g. clothing sidewalk sales)
- Drive thru and external wall mounted

- No outdoor music that is audible from
beyond the property line shall be permitted
8.The Kildaire Farm Road frontage shall have a
minimum of thirteen (13) 4 ½" caliper, streetscape deciduous trees;
twelve (12) 3 to 3 1/2" caliper ornamental trees, and twelve (12) 8’
minimum height Holly trees. The thirty-three-(33) foot landscape buffer
along Kildaire Farm Road shall be planted to meet the Town of Cary’s
requirements for a "semi-opaque" Type B buffer. A combination of
landscaped earthen berm, planted vegetation and existing vegetation will
be used to construct a six (6) foot tall semi opaque screen. At least 75
percent of the required shrubs shall be locally adapted evergreen species.
Existing vegetation or planted deciduous and evergreen trees shall attain
a height at maturity of no less than forty (40) feet. Tree spacing shall
be no wider than thirty (30) feet between tree trunks (may be wider
depending on tree type) with evergreen shrubs spaced five to eight feet on
center.
9.The developer will submit the Kildaire
Farm Road streetscape landscape plan for the thirty-three foot buffer to
the Lochbain Homeowners Association for review and comment. This shall be
done prior to submittal of the site plan to the Town for review. At the
time of site plan submittal to the Town, the owner will provide written
documentation that this has been done.
10. Evergreen landscape plantings having a
minimum mature height of four (4) feet will be used to screen the cemetery
from off-site views.
11. Total parking shall comply with the
Unified Development Ordinance (UDO) standards for parking. Additionally,
restaurant parking shall be based on number of seats or occupancy,
whichever requires more parking. It is not the intent of this part to
prohibit shared parking arrangements as permitted by the UDO.
12. Site plan and architectural study model
shall be submitted as condition of re-zoning. The model shall be provided
to the Town in the form of 3-dimensonal photos.
13. Parking lot will be screened using a
minimum of twenty-eight (28) up to a maximum thirty-two (32), eight foot
tall Leyland Cypress planted along the west side of Kildaire Farm Road in
the fifty (50) foot buffer subject to the attainment of necessary
easements. Where existing tree canopy may inhibit growth of these Cypress,
other eight-foot tall evergreen trees (e.g. Holly etc.) may be substituted
with the concurrence of the homeowner(s) of the abutting lot(s). The
developer will submit the tree installation plan to the Lochbain
Homeowners Association for review and comment. This shall be done prior to
submittal of the site plan to the Town for review. At the time of site
plan submittal to the Town, the owner will provide written documentation
that this has been done. The planting materials required by this condition
will be installed prior to the issuance of a building permit, except if
planting would occur in the months of June, July or August or other
periods when the Town of Cary’s water restrictions would prohibit
watering.
14. Pending Town of Cary and North Carolina
Department of Transportation approval, the owner will install cross walk
light and button for Kildaire Farm Road pedestrian crossing. Installation
shall occur prior to issuance of the first Certificate of Occupancy.
15. Exterior building façade shall be
constructed predominately of reddish/brown brick. Exterior pitched roof
features shall be asphalt shingles. Gables to have cedar shake or wood
siding. All pillars to be constructed from brick/concrete or wood.
Railings shall be constructed of metal.
16. The west-bound lane of Loch Highlands
Drive will be re-striped in the vicinity of its intersection with Kildaire
Farm Road.
