density residential. However, due to a change in the zoning conditions

FINAL CONDITIONS:
| 1.The
total number of dwellings units within this tract shall not exceed
nineteen (19) dwelling units. These units shall be detached units
and consist of a "patio home" style of single-family
development. |

2. A minimum of 4.20
acres of open space shall be provided as generally set forth and
labeled in Zoning Exhibit A (Tract B). This open space shall contain
no buildings or permanent structures and left in a natural state
except for the provisions listed below. Drives and utilities may be
permitted to cross this open space. Areas for this open space may
apply to the overall density calculations for the site. |

3. Existing trees
that fall within the open space area described above and labeled on
zoning Exhibit A (Tract B) shall be saved. Trees will be saved
unless one of the following circumstances necessitates the removal
of selected trees.
- Removal of diseased, damaged dead,
dying, or infested materials;
- Removal of noxious weeds and
plants;
- Maintenance of any recorded
easements;
- Maintenance of any dedicated
right-of-way;
- Construction of trails, sidewalks
or paths for the purposes of pedestrian access;
- Construction of utilities; and
- Construction of entrance drives.

| 4.
Unless otherwise required by the Town of Cary, direct access to
Normandy Street, Pamlico Drive and Union Street shall be prohibited. |
| 5.
Prior to site plan approval for any portion of the property, a
concept plan shall be submitted to the Town Council for review. The
plan shall include the approximate placement of building(s) and
parking areas. This plan will also address measures to insure
overall compatibility of the development’s architecture with the
surrounding area. |
| 6.
All development shall abide by the watershed protection and stream
buffer ordinances of the Town of Cary. |
| 7.
Total impervious cover for Tract B shall not exceed 50%. |
| 8.
At the time of the first site plan approval, the owner shall
dedicate to the Town of Cary the necessary easements for the
construction of a public greenway through the open space area. This
dedication shall be specified and shown on the plans and provided
for recording within thirty (30) days of site plan approval. |
