8 Conditional Use (R-8 CU) This
Mixed Use Sketch Plan is associated with rezoning case 06-REZ-22, which
would amend the zoning conditions and incorporate the property into the
adjoining West Park Neighborhood Mixed Use Center Overlay District. ·
Existing zoning
conditions: Limit
development to single-family, detached residential use.
Minimum lot size in Tract B will be 10,000 square feet. ·
Proposed zoning
conditions: Development
utilizing base zoning (R8 CU)
shall be limited to a lot size of 10,000 square feet.
Development utilizing of a Mixed Use Sketch Plan would allow uses
permitted within a Mixed Use Overlay District with no minimum lot size
requirement. Conformity
with Land Use Plan Designation The
proposed use of the property complies with the Medium Density Residential
(MDR) designation approved by the Town Council November 14, 2006 (case 06-CPA-09). Location Vicinity map South

Project
Description The
plans propose a one-story building containing 5,850 square feet and
associated parking to support six-two bedroom apartment units.
The proposed density would be 4.51 units per acre.
The maximum density allowed is 8 units per acre. The
site would be accessed by one drive from Green Level West Road extending
to parking located behind the building.
Roadway widening is also proposed along Green Level West Road for
the length of property frontage. The
property is inside Cary’s town limits. The
applicant advises that the six apartment units would provide housing
for persons with developmental disabilities.
The applicant is a non-profit corporation that manages
affordable housing for special needs persons, and has received a grant for
the development of housing on this site.
The applicant has also received approval of necessary funding to
construct the project. Traffic Impact Analysis A
Traffic Impact Analysis (TIA) will not be required for the 1.33 acre MDR
parcel. Utilities (Water
and Sewer) Municipal
services are available to the property.
The proposed project will be required to comply with all town water
and sewer standards. Parks &
Greenways According
to the approved PRCR Facilities Master Plan, there are no required parks
or greenways associated with this site. Environmental Considerations At
time of development plan submittal, the proposed project will comply with

Action:
The Mixed Use Sketch Plan was forwarded to the Planning and Zoning
Board for consideration at its December 18, 2006 meeting. Feedback at Town Council Public Hearing At
the September 28, 2006, public hearing, no one spoke in opposition to the
proposed Land Use Plan amendment, proposed rezoning, and proposed Mixed
Use Sketch Plan for the proposed Serving Cup development. Changes since the Town Council Public
Hearing There
have been no significant adjustments made to the plan since the public
hearing. Staff observation on the Sketch Plan Staff
advises that the Serving Cup Mixed Use Sketch Plan complies with all Mixed
Use Sketch Plan requirements, Mixed Use Center Design Guidelines and
applicable Land Development Ordinance requirements.
Staff recommends forwarding the plan to the January 11
or 25, 2007 Town Council meeting with a recommendation for approval

Action: The Serving Cup Sketch Plan was unanimously recommended for approval by a vote of 8-0; therefore, it will move forward to the January 11, 2007 Town Council meeting for a vote of approval/denial on consent. Town
