REQUEST:

The applicant is requesting a minor special use for a manufactured home to be located in the R-40 zoning district.  The UDO requirements allow manufactured homes provided the Zoning Board of Adjustment issues a minor special use permit.

BACKGROUND:

The property consists of 2.6 acres and will be used for manufactured homes.

The property is surrounded by farmland, forestry and single family land uses.

The manufactured home will be connected to a well and septic system approved by Wake County Health Department.

A permanent enclosed foundation will be used for under-skirting.

The comprehensive plan calls for low to medium density (LDR -1 to 3 and MDR - 3 to 8 units per acre).

The property is served by Wake County Fire and EMS

Two off-street parking spaces have been provided.

STANDARDS OF REVIEW:

Section 5.4.7 of The Cary Unified Development Ordinance requires that the Board of Adjustment makes the following findings, based on the evidence and testimony received at the public hearing or otherwise appearing in the record of the case:

  1. That the proposed use or development will not materially endanger the public health or safety;.

  2. That the proposed use is reasonably necessary for the public health or general welfare, such as enhancing the successful operation of the surrounding area in its basic community functions or by providing an essential service to the community or region;

  3. That the proposed use or development of the land will not substantially injure the value of adjoining or abutting property;

  4. That the proposed use or development of the land will be in harmony with the scale, bulk, coverage, density and character of the area or neighborhood in which it is located;

  5. That the proposed use or development of the land will generally conform with the Comprehensive Plan and other official plans adopted by the Town;

  6. That the proposed use is appropriately located with respect to transportation facilities; water supply, fire and police protection, waste disposal, and similar facilities;

  7. That the proposed use will not cause undue traffic congestion or create a traffic hazard.
