You filed a ‘Notice of zoning citation #07-ZV-068 Appeal’ by Elizabeth C. Nowell Family Limited Partnership dated July 6, 2007, which was received in my office July 11, 2007. To the extent the ‘Appeal’ is an appeal of the determination that there exists a Zoning Violation, or that The Elizabeth C. Nowell Family Ltd. Partnership is in violation of the Town of Cary LDO, your appeal is not timely. To the extent your appeal is of the civil penalty, your appeal was received in my office on July 11, 2007, a date that is more than thirty days ‘from the final appeal period of the enforcement decision related to the civil penalty’ and is not timely.

Because the appeal was not made within the time required, I am without authority to hear or consider your appeal.
