RE:  Notice of Zoning Citation - Nonconforming Pole Sign at East Chatham Street, Cary, NC
        (07-ZV-068)                       (Real ID #0090270)

 

Dear Mr. Hickman, E.C. Nowell Family Ltd. Partnership, and Ms. Waller:

 

A Notice of Violation (case number 07-ZV-068) (enclosed) was received by you on April 29, 2007.  In this letter, you were advised that failure to comply with this request within 30 days would result in the issuance of civil citations. 

 

A subsequent inspection was preformed on location on May 29, 2007 where the referenced sign was still observed. At this time we are imposing a civil citation effective May 29, 2007 as shown in the fine structure listed below in accordance with the Town of Cary Land Development Ordinance (LDO).   As of June 1, 2007, the current total citation amount is $2,850.00.  This amount will continue to accrue until the violation has been corrected and the case has been closed with the Town of Cary.  Please call me (919) 462-3885 to schedule a re-inspection of your property when the sign has been removed.  

 

The Town of Cary Sign Ordinance fine structure for illegal signs is as follows:

 

-One hundred dollars ($100.00) per sign, per day for the first day of violation

-Two hundred fifty dollars ($250.00) per sign per day for the second day of violation

-Five hundred dollars ($500.00) per sign per day for the third day of violation

-Five hundred ($500.00) per sign per each day thereafter that the sign ordinance is being violated.

 

Corrective Action Required:  Remove the illegal pole sign immediately. Remit all fines associated with this civil citation to the Town of Cary Finance Department.

 

 

To pay the citation, please go to the Finance Department, Collections Division, located at 316 N. Academy Street or you can mail a check to the Finance Department, Town of Cary, P. O. Box 8005, Cary, NC 27512-8005.
