Approval of the November 14, 2007 Meeting Minutes

Motion to approve made by Doug Harned. 

 Seconded by Nathaniel Parker.  

Minutes were approved unanimously by a vote of 2-0. (Only those present at the November 14, 2007 participated in the vote.)

08-SP-003:  Falcone Point At Old Apex

 

 

 

 

 

 

 

 

 

 

 

Mr. Kevin Hales, project case manager, provided commission with a brief overview the proposed townhome development.   

Woody Yates, representative from Habitat for Humanity, was also present to speak on behalf of the project.  

Following the presentation, the commission members voiced the following concerns:  

1.   Ms. Julia Rudy expressed concern regarding the removal of the vehicular connection between the two sites.  Mr. Hales explained a waiver has been filed from meeting the connectivity ordinance, and the Engineering Department is in support of this waiver.  No concerns have been raised by staff regarding the layout as proposed.  

2.   Mr. Doug Harned voiced concerned in relation to the amount of impervious surface generated by the proposed development.  In speaking with Matt Flynn, Town of Cary ’s Stormwater Field Services Administrator, prior to the meeting, Mr. Flynn informed Mr. Harned that the development is meeting all stormwater and erosion control requirements.  Homeowner Associations are required to maintain all sandfilters on site. 

3.   Mr. Linda Gunter was apprehensive about the maintenance associated with private roadways and the financial impact it had on Homeowner Associations.  Mr. Hales noted this development consisted only of a parking lot.  No public roadways are included.    

4.    Mr. Richard Redfoot questioned the limits associated with excess parking.  Mr. Hales stated that there are only parking maximums for commercial uses.  Staff would not be in support of reducing the number of parking to seven spaces per unit.  

5.   Mr. Nathaniel Parker asked the nature of the common area/open space located in the northwest corner; if a  public access easement would be provided.  Mr. Hales verified an access easement would be provided via sidewalks, along with some general access from the parking lot. 

 Motion made by Mr. Richard Redfoot to approve the plan, along with the associated waiver to eliminate the connection.   

Motion was seconded by Mr. Doug Harned.  

Motion was approved unanimously by a vote of 6-0.

07-SP-030: Cary First United Methodist Parking Expansion

Mr. Redfoot acknowledged he did not feel that his concerns (recorded at the November 14, 2007 meeting) regarding the Cary First United Methodist site were fully presented at the December 13, 2007 Town Council meeting.   

Mr. Nathaniel Parker stated he believed that any conditions, noted by the Commission in association with approval, should be fulfilled prior to final approval of the proposed development plan.

Mr. Bob Benfield, Principal Planner, agreed that in the future staff would work better in calibration with the Commission to ensure that all concerns are addressed, accurately conveyed and fully represented.
