A.  Call to Order (Chairman Brooks)

1.   Chairman Brooks announced that the Sears Farm PDD Amendment and the Cornerstone MUSP were administratively rescheduled (with consent of the applicants) to the June 18th P&Z meeting.

B.   Approval of the Minutes of the April 16, 2007 Meeting
   
   (Chairman Brooks)

Mr. Fenn requested a change of the word “any” to “cluster” on item #8 second sentence first word of paragraph one.

C.   Rezoning, Comprehensive Plan Amendment, or Mixed Use Sketch Plan 
   
   requests with a public hearing:

1.       07-CPA-01 Evans Estates Phase II CPA presented by Ms. Meredith 
Chandler                      

Motion to approve:  Mr. Don Frantz motioned that the Planning and Zoning Board recommends Town Council amend the Comprehensive Plan Use designation from Medium Density Residential (MDR) to Low Density Residential (LDR) and that the Board finds this amendment consists with spirit and intent policies with the goal of the Town of Cary Comprehensive Plan Amendment an any other plan applicable.

Discussion
:  Mr. Hari Nath questioned what the Board’s criteria is for approving the Comprehensive Plan Amendment.  Ms Meredith Chandler outlined the four criteria per Section 3.2.2 (LDO) and how they apply to this case.

Ms. Wayman and Mr. Brooks indicated that they preferred the property be amended from Medium Density Residential (MDR) to Low Density Residential to Medium Density Residential (LDR to MDR) because it provided a better transition and offered flexibility to the applicant.

                        Vote:    6-2   (Against: Ms. Joy Wayman and Chairman Mr. Christopher Brooks)

D.   Rezoning, Comprehensive Plan Amendment, or Mixed Use Sketch Plan

equests with no public hearing:

1.       06-MU-03 Village at the Park Mixed Use Sketch Plan presented by Ms. Debra Grannan

Motion to approve
:  Ms. Joy Wayman made a motion to recommend approval of the mixed use sketch plan as 
presented.

2.       07-REZ-02 West Lake PDD Amendment presented by Ms. Jennifer Currin                  

Motion to approve:  Ms. Joy Wayman made a motion to recommend that Town Council adopt an ordinance allowing the request to rezoning that is consistent with the Town of Cary Comprehensive Plan or any other official adopted plan or applicable.

3.       07-REZ-05 Park at West Lake Rezoning presented by Ms. Jennifer Currin

Motion to approve:  Ms. Kelly Comiskey made motion that the board sends 07-REZ-05 to Town Council with a recommendation of an approval.

4.       07-REZ-07 Gaglione Rezoning presented by Ms. Debra Grannan

Motion to approve:   Ms. Joy Wayman made a motion to recommend that Town Council adopt an ordinance allowing this request for rezoning that is consistent with current Town of Cary Comprehensive Plan and any other officially adapted plan that is applicable.
