Note:  Bill Johnson has tendered his resignation due to a move from the area.

A.  CALL TO ORDER (Chairman Brooks)   

B.  APPROVAL OF THE MINUTES: 

1.  February 20, 2006 (Tabled)

Chairman Brooks asked if there was a motion to bring back the February 20, 2006 tabled minutes.  Matthew Danielson made the motion which was seconded by Harry Baulch. (no vote taken)  

Matthew Danielson made a motion to approve the minutes.  Harry Baulch seconded, and the motion carried by a vote of 5-2.  (Kelly Commiskey and Don Frantz voted no)   

2.  April 17, 2006  

Don Frantz made a motion to approve the minutes.  Kelly Commiskey seconded, and the motion carried unanimously 7-0.

C.  TOWN COUNCIL REPORT    

1.  Town Council Meeting May 11, 2006 (Council Member Robinson)   

D.  SITE PLANS   

1.  The Learning Experience 06-SP-023 

Carla Sadtler made a motion to forward 06-SP-023 to Town Council for approval according to the wording in the staff report.  Matthew Danielson seconded, and the motion carried unanimously 7-0. 

Comments after the motion:

Not comfortable with the argument that the bio-retention areas and road widening have created the need for this buffer reduction.  These are normal development things, and this argument could become a problem in the future.  No problem with this particular site because the neighbor doesn’t object and the future Office and Institutional land use for the next property.   

E.  REZONING with no public hearing:

1.  06-REZ-06 Roberts Farm Property 

Harry Baulch made a motion to forward 06-REZ-06 to Town Council for approval according to the wording in the staff report.  Don Frantz seconded, and the motion carried unanimously by a vote of 7-0.   

F.  REZONING, COMPREHENSIVE PLAN AMENDMENT, or CONCEPT PLAN with a public hearing:   

Please adhere to the following guidelines:   

1.  06-REZ-02 Weldon Ridge Planned Development District Amendment  

Carla Sadtler made a motion to forward 06-REZ-02 to Town Council for approval according to the wording in the staff report.  Harry Baulch seconded, and the motion carried unanimously 7-0.   

2.  06-CPA-01 Regency Park Comprehensive Plan (CPA) Amendment

A Lions Gate Homeowners Association representative spoke during the public hearing.  They understand that the CPA and the rezoning request that will follow at a later date, are separate evaluations.  They still feel the need to make comments on the rezoning at this time.  Summary of resident concerns comprised three issues:  building height, density, and traffic impact.  Also, mixed-use is not well defined at this point, and future decisions could raise resident concerns.

Comments during the discussion after the motion:       

P&Z Board members felt that taking large areas for an expanding business and trying to get into residential will be a mistake in the future.  Weston and Essex Office Park were cited as examples.

Other P&Z Board members said mixed-use made sense, and that some people were trying to live closer to where they work.

Carla Sadtler made a motion to forward 06-CPA-01 to Town Council for approval according to the wording in the staff report.  Harry Baulch seconded, and the motion carried by a vote of 5-2.  (Kelly Commiskey and Don Frantz voted no.)   

3.  06-CPA-02 Fryar Property Comprehensive Plan Amendment (Philip Smith)  

Carla Sadtler made a motion to recommend denial of 06-CPA-02.  Kelly Commiskey seconded.   

Discussion after the motion: 

There were comments about the request for an area of Commercial.  Would it not be better to look at the Southwest Area Plan in total if we are going to redo this area?  There is a big difference between what is on the east/west side of I-540.  Very Low Density Residential currently to Low Density Residential and Commercial is quite a jump in the usage of the Plan.

Other members thought the Commercial wasn't unreasonable, it was the approval of development with the questionable timing of I-540 coming to the area.

The motion failed by a vote of 1-6.  (Carla Sadtler voted in favor of denial; other P&Z Board members voted against the motion for denial.)   

Don Frantz made a motion to forward 06-CPA-02 to Town Council for approval according to the wording in the staff report.  Harry Baulch seconded, and the motion carried 6-1 (Carla Sadtler voted no).   

4.  06-CPA-03 Bashyam Property Comprehensive Plan Amendment 

Tabled until the June 19 P&Z Board Meeting
