Harry Baulch arrived at 6:43 PM.

A.  CALL TO ORDER (Chairman Dawson)

B.  APPROVAL OF THE MINUTES OF THE October 24, 2005 MEETING


Matthew Danielson made a motion to approve the minutes.  This was seconded by Christopher Brooks, and the motion passed by a vote of 7-0. 

C.  TOWN COUNCIL REPORT

1.  Town Council Meeting November 10, 2005 (Council Member Robinson) 

D.  SITE/SUBDIVISION PLAN 

1.  Site Plan 05-SB-015 Terrington Subdivision 
The applicant has requested additional time to make necessary modifications to the subdivision plan and requests that the plan remain tabled until the
December 19, 2005 Planning and Zoning Board meeting. 

Matthew Danielson made a motion to table 05-SB-015 until the December 19, 2005 Planning and Zoning Board meeting.  This was seconded by Christy Perrin, and the motion passed by a vote of 7-0.

E.  CONCEPT PLAN 

1.  Alston PL06-023

Motion:  Wally Dawson made a motion to table Alston until the December 19, 2005 Planning and Zoning Board meeting.  This was seconded by Carla Sadtler, and the motion passed by a vote of 8-0.  (Harry Baulch had not arrived for the first two votes.) 

F.  REZONINGS, LAND USE PLAN AMENDMENTS, AND CONCEPT PLANS FOR PUBLIC HEARING AND ACTION: 

Please adhere to the following guidelines: 

  • Proceed to the podium and state your name clearly.
  • Public testimony is limited to comments on new or substantially changed
    aspects of the request which have occurred following the public hearing held by the Town Council.
  • Be concise; avoid repetition; limit comments to five minutes or less, and designate a spokesperson for large groups.
  • Following your presentation, print your name on a form provided by the Board Secretary to ensure the official record reflects the correct information.
  • Provide the Board Secretary any documents or materials presented to the Board.

1.  05-REZ-30 Tripathi Property

Matthew Danielson made a motion to approve 05-REZ-30 as recommended by staff.  This was seconded by Harry Baulch, and the motion passed by a vote of 8-0. 

Concerns Discussed:

  • Buffers- As a condition of the rezoning the applicant will install a 10’ type B buffer adjacent to all residential property.
  • Traffic- Reedy Creek Road has several bends and curves that cause concern about safety.

2.  05-REZ-32 Northwoods Planned Development District (PDD) Amendment

Christy Perrin made a motion to approve 05-REZ-32 as recommended by staff.  This was seconded by William Lyke, and the motion passed by a vote of 8-0.

The Board did not voice concerns regarding this item and supported staff’s recommendation.

3. 05-REZ-33
Cary Arboretum

Matthew Danielson made a motion to approve 05-REZ-33 as recommended by staff.  This was seconded by Kelly Commiskey, and the motion passed by a vote of 8-0. 

The Board did not voice concerns regarding this item and supported staff’s recommendation.

4.  05-AC-007 Northwoods Activity Center Concept Plan (ACCP) Amendment
Kelly Commiskey made a motion to approved 05-AC-007 as recommended by staff.  This was seconded by Harry Baulch, and the motion passed by a vote of 5-3.
William Lyke, Christy Perrin, and Carla Sadtler voted against the motion.
 

Reasons for majority vote:
The majority vote was made in recognition that the size and shape of the parcel and limited access to Maynard Road favored residential development.  Further, the medium density product being proposed is in conformance with the standards of an activity center.

Reasons for Dissenting Vote:
The dissenting members expressed concerns that the buffers needed additional consideration and that office was a better use for this parcel than residential.
