Planning & Zoning Board Recommendation:

The Planning and Zoning Board recommended approval of the plan, with a vote of 7 yes votes to 2 no votes. The recommendation of approval included the following conditions:
  • That the street front area along Cary Glen Boulevard be planted to an opaque standard.
  • That all required shrubs be initially installed at a minimum height of 24".
  • That an intermittent evergreen landscape screen be installed along the low side of all retaining walls over 5' in height.

Staff Recommendation:

Staff recommends approval of the plan with the following conditions:

PROJECT DESCRIPTION

The plan proposes 230 apartment units on 9.39 acres known as Parcel MR-8 on the Cary Park Master Plan. The apartments would be located in five three-story buildings (four stories including first floor parking under the building). The building height is approximately 43', 3". The maximum density allowed is 25 units per acre, and the minimum density allowed is 15 units per acre, and the proposed density is 24.49 units per acre. An office and pool area would be located in Building 1. The site would be accessed by one drive from Cary Glen Boulevard, the drive would provide access to surface parking and parking located under the buildings. The plan also provides vehicular and pedestrian access to the adjoining southern vacant property.

ZONING AND LAND USE PLAN COMPLIANCE

Current Zoning: Residential-40 District

Overlay District: Planned Unit Development (Cary Park), With Multi-family Designation

Town Limits: Inside

Land Use Compliance: The proposed development complies with the Cary Park Master Plan and most general zoning requirements.

The plan has been modified to address all previous staff and Planning and Zoning Board concerns:

  • The plan no longer proposes to reduce the required amount of parking (478 parking spaces are required, 480 spaces are proposed).
  • The plans propose a continuous minimum 15' streetscape along Cary Glen Boulevard.
  • Building 3 has been moved from 4" from the right-of-way of Cary Glen Boulevard to 45' from the roadway right-of-way.
  • The southern sewer main being extended to the site has been relocated out from under a proposed retaining wall.
  • The addition of a pedestrian crosswalk, crossing Cary Glen Boulevard, is included on the plan and was coordinated with Cary's Engineering Department. The developer proposes to post a bond for the future construction of the crossing, including signage and handicap access. The bond amount would be based on a Town of Cary approved construction cost estimate prepared by Rice & Associates. The actual location of the crossing and related appurtenances would be determined at site plan approval for the retail center across Cary Glen Boulevard. The crosswalk would comply with MUTCD and Town of Cary standards.

As of this writing there are two landscape related zoning requirements that the plan does not meet:

  • That the street front area along Cary Glen Boulevard be planted to an opaque standard.
  • That all required shrubs are initially installed at a minimum height of 24".
  • That an intermittent evergreen landscape screen be installed along the low side of all retaining walls over 5' in height.

Staff is recommending approval of the plan with the condition that the plan be modified to address these two requirements.

Current Enrollment and Building Capacity is based on the 20th day of the school year for 2001. School assignment will be determined at the time of development. A list of individual area schools can be reviewed at: School Data

Staff has received for this development a Certificate of Adequate Facilities for Schools from the Wake County School System. The Certificate indicates that adequate seating would be available at designated schools at the time of occupancy. Actual school locations would be announced.

LANDSCAPE

The plan currently does not include an opaque screen along Cary Glen Boulevard, and the minimum shrub size for all required shrubs at planting should be 24". The current plan proposes a shrub size ranging from 18" to 24". The plan complies with all other landscape requirements and staff recommendations.

 

BUILDING ELEVATION

Building Height: 43'-4"

Building Size: 230 units in five three-story buildings containing a total of 294,281 square feet.

Building Materials & Colors: Red/brown brick, beige siding, green shutters, white trim, and medium brown asphalt shingle roof.

TRAFFIC

A Cary Park Development Agreement was approved November 2001.

As part of this agreement the developer provides:

  1. Panther Creek Parkway – Green Level to Durham Road to I-540 (Western Wake Expressway).
  2. Green Level to Durham Road – southern boundary of Cary Park to a point 200 feet south of the intersection of Green Level to Durham Road & Carpenter Fire Station Road.
  3. Cary Glen Boulevard – Carpenter Fire Station Road to 800 feet to the south. - Complete
  4. Cary Glen Boulevard – Carpenter Fire Station Road to Panther Creek Parkway.

As part of this agreement the Town provides:

  1. Panther Creek Parkway – I-540 (Western Wake Expressway) to NC 55 – Complete construction 2004
  2. Any road improvements to Yates Store Road
  3. Green Level to Durham Road – Panther Creek Parkway to a point 200 feet south of the intersection of Green Level to Durham Road & Carpenter Fire Station Road.
  4. Traffic signals with additional lanes for intersection improvements:
    1. NC 55 & Carpenter Fire Station Road
    2. NC 55 & Panther Creek Parkway
    3. Green Level to Durham Road & Alston Avenue
   5.  New traffic signals:
  1. Green Level to Durham Road & Cary Glen Boulevard
  2. Green Level to Durham Road & MR-2A&2B
  3. Carpenter Fire Station Road & Cary Glen Boulevard
