ZONING BOARD OF ADJUSTMENT
11/13/01 MINUTES

1.  Call to Order

The meeting was called to order by Chairperson Weaver at 7:30 p.m.
2.  Roll Call
Board Members Present-Voting: Chairperson Gaines Weaver, Jeffrey Bartley, John Berndt, ETJ, Robert Cassell, T.C. Frick, Vice-Chair Allan Koeppel, John Werner, Steve Crutchfield, Larry Snead, Alternate and Michael Cantrell, Alternate.

Board Members Absent: Joyce Jordan, Eric Strom and Lair Block, Alternate.

Staff Present: Chris Simpson, JW Shearin, Suzanne Prince, Walter Harris and Joanne Gunther.

 

3.  Action on Minutes from the October 8, 2001 meeting.

Mr. Werner made a motion to approve the minutes, which was seconded by Mr. Frick, and the Board voted (10-0) to approve the minutes. 

 

4.  Sworn Testimony

The following individuals were sworn in to give testimony:  Frank Corbi, Carol Corbi, Suzanne Prince, JW Shearin, Robert Ide, Eleanor Ide and Kathleen Ide.

 

5.  Case Hearings

APPLICATION #: 01-A-015

STAFF CONTACT:  Suzanne Prince

SUBJECT PROPERTY:  313 Silverberry Court, Cary, NC 27513

APPLICANT: Artisan Recreational Structures, Inc.

OWNER(S): Frank and Carol Corbi

REQUEST: The applicant is requesting a variance of 1.5 feet to bring a nonconforming structure into compliance.  The applicant is also requesting a variance of an additional 10 feet in order to add a screened porch in the area of the existing concrete patio and to address an existing shed encroachment.  The total variance requested is 11.5 feet.

ACTION:  Mr. Snead, relying upon the precedent of a variance having been granted in 1998 to the unit at the end of the 4 unit structure, made a motion to approve application number 01-V-015 to run with the existing structure, which was seconded by Mr. Bartley, and the Board voted (9-1) to approve.

APPLICATION #: 01-V-016

SUBJECT PROPERTY: 104 Alidade Court, Cary, NC 27513

APPLICANT: Mike Hunter

OWNER(S): Robert & Renee Sember

REQUEST: The applicant is requesting a variance to encroach 2.7 feet into the sideyard setback of the home to address an existing encroachment of the home 2.7 feet into the sideyard setback. The home is 8 years old, and the encroachment was only recently discovered.

ACTION: Mr. Koeppel made a motion to approve application number 01-V-016 to run with the structure, which was seconded by Mr. Cassell, and the Board voted (10-0) to approve.

 

APPLICATION #: 01-V-017

SUBJECT PROPERTY: 706 Collington Drive, Cary, NC 27513

APPLICANT: Champion Window Company

OWNER(S): Robert & Eleanor Ide

REQUEST: The applicant is requesting a variance to encroach 12 feet, 6 inches into a rear setback of 30 feet for the proposed addition of a patio enclosure.

ACTION: Mr. Koeppel made a motion to deny application number 01-V-017 as it failed to meet the requirements as there was no evidence of a hardship, which was seconded by Mr. Weaver, and the Board voted (7-3) to deny.

 

6.  New/Old Business: Review of 2002 meeting schedule and possible change of meeting time from 7:30 p.m. to 7:00 p.m.

ACTION: Mr. Weaver made a motion to approve the 2002 meeting schedule which included keeping the 7:30 p.m. start time for the Zoning Board of Adjustment which was seconded by Mr. Koeppel, and the Board voted (10-0) to approve
7.  Adjournment:  Mr. Weaver adjourned the meeting at 8:17 p.m.
