ZONING BOARD OF ADJUSTMENT
02/12/01 MINUTES

1.  Call to Order
The meeting was called to order by Mr. Weaver at 7:30 p.m.
2.  Roll Call

Board Members Present-Voting: Jeffrey Bartley, John Berndt, ETJ, Robert Cassell, Steve Crutchfield, T.C. Frick, Joyce Jordan, Allan Koeppel, Larry Snead, Chairman Gaines Weaver and John Werner.

Board Members Absent: Eric Strom

Staff Present:  Chris Simpson, Joseph Jeffries , Lissa Parrish, Lawrence Hardee and Joanne Gunther

3.  Action on Minutes from December 11, 2000 Meeting.

A suggestion was made by Mr. Koeppel to change the December 11, 2000 minutes to reflect that the MSU permit reflect that it is only good for four years with an opportunity for renewal.  The Board voted unanimously (10-0) to approve the suggestion.

4.  Sworn Testimony

The following individuals were sworn in to give testimony:  Joseph Jeffries, Lissa Parrish, Joe Roycroft, Terry Frye and Gerald L. Sydnor.
5.  Oath

Oath's were given to Gaines Weaver as Chairman to the Zoning Board of Adjustment, Lair Block and Michael Cantrell as new alternate members to the Zoning Board of Adjustment.
6.  Case Hearings

APPLICATION #: 01-V-001

STAFF CONTACT: Joseph Jeffries

SUBJECT PROPERTY: 108 Settlers Circle

APPLICANT: Joe and Yvonne Roycroft

OWNER(S): Joe and Yvonne Roycroft

REQUEST: The applicants, Joe and Yvonne Roycroft, are requesting a variance to encroach 6 feet into the 15 foot sideyard setback.

ACTION: A motion was made by Mr. Werner and seconded by Mr. Koeppel that application No. 01-V-001 has successfully met the requirements of Section 6.1.5 of the Cary Zoning Ordinance and is hereby granted, subject to the following conditions and findings:  the variance shall run with the structure.  The Board voted (10-0) to approve the variance.

APPLICATION #: 01-V-002

STAFF CONTACT: Joseph Jeffries

SUBJECT PROPERTY: 440 Fincastle Drive

APPLICANT(S): Gerald L. Sydnor

OWNER(S):  Gerald L. Sydnor

REQUEST: The applicant's variance request has two parts.  Part one consists of a variance to encroach 9 feet into a 10 foot buffer setback.  The second part is a variance to encroach 3 feet into an 18-foot corner sideyard setback.

ACTION: A motion was made by Mr. Cassell and seconded by Ms. Jordan that application No. 01-V-002 has failed to meet the requirements of Section 6.1.5 of the Cary Zoning ordinance and the application is denied due to the following findings:  construction of the garage is not in character with the existing neighborhood.  The Board voted (10-0) in favor of the denial.

 

APPLICATION #:  01-V-003

STAFF CONTACT:  Joseph Jeffries

SUBJECT PROPERTY:  202 Silvergrove Drive

APPLICANT(S):  Zaring Homes, Inc.

OWNER(S):  First Cincinnati Leasing 2000, Inc.

REQUEST:  The applicant, Zaring Homes, Inc., is requesting a variance to encroach approximately 9.5 feet into the 30-foot front setback (Exhibit A - Survey).

ACTION:  A motion was made by Mr. Koeppel and seconded by Mr. Bartley that application No. 01-V-003 has successfully met the requirements of Section 6.1.5 of the Cary Zoning Ordinance and is hereby granted without conditions.  The Board voted (9-1) to approve the variance.

 

7.  New Business:

Council Member Marla Dorrel made an informal report to the Zoning Board of Adjustment thanking them for upholding the integrity of the ordinances.

Mr. T.C. Frick indicated that he would like staff to provide driving directions to the various case sites that are presented to the Zoning Board of Adjustment.
