ZONING BOARD OF ADJUSTMENT

1.  Call to Order
The meeting was called to order by Ms. Wayman at 7:30 p.m.
2.  Roll Call

Board Members Present-Voting: Joy Wayman, Chairperson, Robert Cassell, Michael Spencer, Steve Crutchfield, Allan Koeppel, Eric Strom, John Berndt, ETJ, Joyce Jordan, Gaines Weaver, T. C. Frick and Jeffrey Bartley.

Board Members Absent: John Werner and Larry Snead

Staff Present: Michele Hane, Chris Simpson, Joseph Jeffries , JW Shearin and Joanne Gunther

3.  Action on Minutes from November 13, 2000 Meeting.

A motion was made by Ms. Jordan to correct the minutes of November 13, 2000 to read motion made by Mr. Cassell and seconded by Ms. Jordan. The Board voted unanimously (10-0) in favor of the motion.

4.  Sworn Testimony

The following individuals were sworn in to give testimony: Michele Hane, Joseph Jeffries, Robert Hodgkin, Deborah Yow and William Holder.
5.  Case Hearings

APPLICATION #: 00-18-V

STAFF CONTACT: Michele Hane

SUBJECT PROPERTY: 107 Otter Drive

APPLICANT: William Holder, B.H. Builders, Inc.

OWNER(S): Robert Hodgkin

REQUEST: The applicants are requesting a variance to encroach into the sideyard setback for the purpose of constructing a garage with mother’s suite on the second floor. As proposed, the garage encroaches approximately 1 foot into the required 10-foot sideyard setback.

ACTION: A motion was made by Ms. Jordan and seconded by Mr. Weaver that application No. 00-18-V has successfully met the requirements of Section 6.1.5 of the Cary Zoning Ordinance and is hereby granted, subject to the following conditions and findings: the variance shall be transferable and run with the land. The Board voted (10-0) to approve the variance.


APPLICATION #: 00-19-MSU

SUBJECT PROPERTY: Kenneth E. & Deborah H. Yow

APPLICANT(S): Kenneth E. & Deborah H. Yow

REQUEST: The applicant is requesting a minor special use for a manufactured home to be located in the R-40 zoning district. The UDO requirements allow manufactured homes provided the Zoning Board of Adjustment issues a minor special use permit.

ACTION: A motion was made by Mr. Weaver and seconded by Mr. Koeppel that application No. 00-19-MSU has successfully met the requirements of Section 8.3.3 and 5.4.7 of the Cary Unified Development Ordinance and is hereby granted. The Board voted unanimously (10-0) to approve the minor special use permit.
