ZONING BOARD OF ADJUSTMENT
11/13/00 MINUTES

1. Call to Order
The meeting was called to order by Ms. Wayman at 7:30 p.m.
2. Roll Call

Board Members Present-Voting: Joy Wayman, Chairperson, Robert Cassell, Michael Spencer, John Werner, Allan Koeppel, Eric Strom, John Berndt, ETJ, Joyce Jordan, Gaines Weaver, and T. C. Frick.

Board Members Absent: Larry Snead and Steven Crutchfield.

Staff Present: Michele Hane, Chris Simpson, Karen Pendleton, Joseph Jeffries, Tracy Roberts, Gina Bingham, and Joanne Gunther

3. Action on Minutes from September 11, 2000 Meeting.

A motion was made by Mr. Cassell and seconded by Ms. Jordan to approve the minutes as submitted. The Board voted unanimously (10-0 ) in favor of the motion.
4. Sworn Testimony

The following individuals were sworn in to give testimony: Peter Vaderhyden, David Barrier, James Thompson, Joseph Jeffries, David Camp and Tracy Roberts.
5. Case Hearings

APPLICATION #: 00-16-V

STAFF CONTACT: Joseph Jeffries

SUBJECT PROPERTY: 115 Selly Manor Court

APPLICANT: David Barrier

OWNER(S): James and Aliene Thompson

REQUEST: REQUEST: The applicant is requesting a variance to encroach into the sideyard setback. The existing prinicpal structure encroaches approximately 3.1 feet into the 10 foot side yard setback.

ACTION: A motion was made by Mr. Cassell that application No. 00-16-V has successfully met the requirements of Section 6.1.5 of the Cary Zoning Ordinance and is hereby granted, subject to the following conditions and findings: to run with the existing structure. Mr. Weaver seconded the motion, and the Board voted (10-0) to approve the variance.

APPLICATION #: 00-17-V

STAFF CONTACT: Joseph Jeffries

SUBJECT PROPERTY: The Centrum Shopping Center, 2300 Walnut Street

APPLICANT(S): David Camp

REQUEST: The applicant is requesting a variance to allow an additional 44 square feet of sign area.

ACTION: A motion was made by Ms. Jordan that application no. 00-17-V be denied because of the following: The findings indicate that there is no hardship. The sign meets the specifications required in the Town of Cary Sign Ordinance. Mr. Cassell seconded the motion and the Board voted unanimously (8-2 ) to deny this case.
