  1. Call to Order
    The meeting was called to order by Ms. Dorrel at 7:30 PM and the secretary called the role.

 

  1. Action on Minutes from 11/9/98 Meeting

    ACTION: A motion was made by Mr. Cassell and seconded by Mr. Rudisill to approve the minutes as submitted. The Board voted unanimously in favor of the motion.

    The following individuals were sworn in to give testimony: Joseph Jeffries, Camille McLeod, Mike Christenbury, E.W. Sauls (98-31-V), Stacy O. Hooks (98-31-V), Julia S. Stockton (98-32-V).

APPLICATION #: 98-31-V

STAFF CONTACT: Camille McLeod

SUBJECT PROPERTY: 310 High House

APPLICANT(S): E.W. & Rebecca W. Sauls

REQUEST: The applicants, E.W. and Rebecca W. Sauls, are requesting a variance to allow an existing accessory structure (carport) to be located within the front yard setback

ACTION: A motion was made by Ms. Wayman that application #98-31-V has successfully met the requirements of Section 6.1.5 of the Cary Zoning Ordinance and is hereby granted, subject to the following conditions: Variance shall not be transferable and shall run with the present owner, E.W. Sauls. The motion was seconded by Mr. Watts. The motion failed on a vote of 6-3, with Ms. Dorrel, Mr. Cassell, and Mr. Rudisill casting the dissenting votes.

SUBJECT PROPERTY: 113 High Country Drive

APPLICANT(S): Julia S. Stockton

REQUEST: The applicant,Julia S. Stockton, is requesting a variance to allow 9.68 foot encroachment into a 25 foot rear setback.

ACTION: Mr. Dascombe made a motion that application #98-32-V has failed to meet the requirements of section 6.1.5 of the Cary Zoning Ordinance and the application is denied. Mr. Cassell seconded the motion and the motion carried on a vote of 6-3, with Ms. Harris, Ms. Wayman, and Mr. Watts casting the dissenting votes.

APPLICANT(S): Julia S. Stockton

REQUEST: The applicant, Julia S. Stockton, is requesting a minor special use for the expansion of a nonconforming structure.

ACTION: It was not necessary to hear this request for a minor special use because the request for the variance (98-32-V) was denied.
