James REQUEST: The applicants are requesting a variance to construct a 2-car garage in the corner sideyard setback. As proposed, a corner of the garage encroaches roughly 6 feet into the 25-foot corner sideyard setback. ACTION: A motion was made by Mr. Koeppel that application No. 00-12-V has successfully met the requirements of Section 6.1.5 of the Cary Zoning Ordinance and is hereby granted, subject to the following conditions and findings: to run with the land. Ms. Jordan seconded the motion and the Board voted (7 - 3). Motion for the variance was denied. |

Phillips REQUEST: The applicant is requesting a variance to correct a sideyard encroachment of an illegally constructed garage. The garage encroaches 7-feet into the required 10-foot sideyard setback. ACTION: A motion was made by Mr. Weaver that application no. 00-13-V not be heard before the Zoning Board of Adjustment because there have not been substantial changes in the conditions or circumstances relating to the matter since December 1986. Mr. Frick seconded the motion and the Board voted unanimously (10-0) to deny hearing the above case. |

STAFF CONTACT: Michele Hane SUBJECT PROPERTY: 124 Brannigan Place APPLICANT(S): Ronald & MaryLu Radloff REQUEST: The applicants are requesting the variance to encroach into the sideyard setback for the purpose of constructing a garage. As proposed, the garage would encroach approximately 4 feet into the required 10-foot setback. ACTION: A motion was made by Mr. Koeppel that application No. 00-14-V has failed to meet the requirements of Section 6.1.5 of the Cary Zoning Ordinance and the application is denied. Mr. Spencer seconded the motion and the Board voted (9-1) to approve the motion to deny due to the following findings: no significant hardship. |
