  1. Call to Order

    The meeting was called to order by Ms. Wayman at 7:30 PM.
  • Action on Minutes from May 8, 2000 Meeting

    ACTION: A motion was made by Ms. Jordan and seconded by Mr. Cassell to approve the minutes as submitted. The Board voted unanimously (10-0) in favor of the motion.
  • The following individuals were sworn in to give testimony: Tracy Roberts, Matthew Griffin, Lindy L. Sfirlea, Peter R. Uhlik, Scott hentley, William Woodworth

  • APPLICATION #: 00-06-V

    STAFF CONTACT: Matthew Griffin

    SUBJECT PROPERTY: 203 O’Kelly Lane.

    APPLICANT(S): William and Wendy Woodworth

    REQUEST: The applicants are requesting the variance to correct a nonconforming structure. Their garage currently encroaches into a side yard setback.

    ACTION: A motion was made by Ms. Jordan that application no. 00-06-V has successfully met the requirements of Section 6.1.5 of the Cary Zoning Ordinance and is hereby granted, subject to the following conditions: Variance shall be transferable and run with the structure. Mr. Koeppel seconded the motion and the Board voted unanimously (10-0) in favor.

    APPLICATION #: 00-07-V

    STAFF CONTACT: Matthew Griffin

    SUBJECT PROPERTY: 101 Old Dock Trail.

    APPLICANT(S): Peter Uhlik

    REQUEST: The applicant is requesting a variance to allow a rear yard encroachment of roughly 6 feet for the purpose of installing a deck.

    ACTION: A motion was made by Mr. Weaver that application no. 00-07-V has successfully met the requirements of Section 6.1.5 of the Cary Zoning Ordinance and is hereby granted, subject to the following conditions: Variance shall be transferable and run with the land and the variance will expire on December 31, 2000. Mr. Koeppel seconded the motion and the Board voted (3-7) Mr. Berndt, Mr. Spencer, Mr. Weaver in favor of the variance, the remaining Board members voted against granting the variance.

    ACTION: A motion was made by Mr. Cassell that application no. 00-07-V has successfully met the requirements of Section 6.1.5 of the Cary Zoning Ordinance and is hereby granted without conditions. Mr. Crutchfield seconded the motion and the Board voted (7-3) in favor of the variance, Mr. Bartley, Mr. Berndt and Mr. Weaver voted against granting the variance.

    ACTION: A motion was made by Ms. Jordan that application no. 00-07-V has successfully met the requirements of Section 6.1.5 of the Cary Zoning Ordinance and is hereby granted, subject to the following conditions: Variance shall be transferable and run with the structure. Mr. Cassell seconded the motion and the Board voted (9-1) in favor of the variance, Mr. Weaver voted against granting the variance.
