Background:  On October 20, 2004, The Town entered into a Municipal Agreement with NCDOT to add various elements to the US1/64 widening project.  The Town contributed $8,545,650 to include interchange modifications with Walnut Street and Cary Parkway, various utility improvements, the pedestrian bridge connecting Kids Together Park with MacDonald Woods Park, the Gateway Wall along the southbound loop to Walnut Street and sidewalk installation along Cary Parkway.  Construction activities for this project are mostly complete with various minor punch list items now being addressed.

Supplemental Agreement: Throughout the construction duration, Town and NCDOT staff worked together toward the successful completion of this project.  Collaborative efforts resulted in minor changes to the project scope and additional costs totaling $19,353.63.  Changes in scope and associated costs are listed below and detailed in the attached Supplemental Agreement.

Project Landscaping Update:  Staff presented the landscaping plan, originally proposed to be installed in fall 2007 to Council on April 12, 2007 (EN07-092).  Due to the drought conditions, NCDOT has delayed installation until fall 2008.

Fiscal Impact: Allocate an additional $19,353.63 from a remaining balance of $1,904,292.72 in the construction account of ST1087 for payment to NCDOT.

Staff Recommendation: Approve the attached Supplemental Agreement and Resolution provided by NCDOT to close out this project.
