I.    CLOSED SESSION

 

ACTION: Mayor Pro Tem Smith made the following motion for closed session, which was seconded by Mrs. Robinson and unanimously approved by council:

 

Pursuant to G.S. 143-318.11(a)(3) and (5), closed session was conducted for the following purposes:

 

1. To consult with attorneys employed by and/or retained by the Town in order to preserve the attorney-client privilege between the attorneys and the Town. Among other things, the council expects to receive advice concerning Richard I. Duley v. Town of Cary and BFI Waste Services, LLC.

2. To discuss matters relating to the location or expansion of industries or other businesses in the Town.

 

3. To instruct the Town staff concerning the position to be taken by or on behalf of the Town in negotiating the price and other material terms of contracts or proposed contracts for the acquisition of property owned by Curtis Westbrook, which is located at 320 S. Walker Street.
