SPECIAL MEETING MINUTES OF THE CARY TOWN COUNCIL

November 5, 2004

Noon , Town Manager’s Conference Room, 120 Wilkinson Avenue , Cary , NC

Purpose: To continue the hiring process for the Town Attorney Position

Present: Mayor Ernie McAlister, Mayor Pro Tem Jack Smith, Council Members Julie Robison and Nels Roseland; Council Members Marla Dorrel and Jennifer Robinson were absent during the open session, but both arrived prior to the start of the closed session

Absent: Council Member Mike Joyce

Mayor Ernie McAlister called the meeting to order at 12:03 p.m.

ACTION: Mayor Pro Tem Smith made a motion for closed session pursuant to G.S. 143-318.11(a)(6) to consider the qualifications, competence, performance, character, fitness, conditions of appointment or conditions of initial employment of a town attorney. Mrs. Robison provided the second, and council granted unanimous approval among those present (McAlister, Smith, Robison and Roseland).

At 5:24 p.m. , the following council members returned from closed session back into open session: Mayor Ernie McAlister, Mayor Pro Tem Jack Smith, Council Members Julie Robison and Nels Roseland. Mayor McAlister announced that the council would continue this discussion immediately following the council work session on November 9, 2004 , which is scheduled to conclude at 6:30 p.m.

ACTION: At 5:25 p.m., Mrs. Robison made a motion to adjourn, Mr. Roseland provided the second, and council granted unanimous approval. (Council Members Dorrel and Robinson were not officially excused from the meeting, so the record reflects “aye” votes for them regarding this motion.)
