revising a formal utility service/annexation boundary agreement with the Town of Apex and setting a public hearing date for April 29, 2004. (Approved)

2.    All persons who wish to speak during the following special use public hearing must be administered an oath by the town clerk prior to speaking:

 

Public hearing and consideration of approval of Special Use 04-SU-002: The applicant, Stewart Engineering, Inc., representing Macedonia United Methodist Church, has requested special use and site plan approval to construct a new two-story sanctuary addition to the west side of the existing Church building.  The Church is located north of Tryon Road and west of Jones Franklin Road at 2904 Walnut Street. The property contains 6.78 acres and is zoned Residential 40 District.  According to Land Development Ordinance Section 5.2.2(E), churches located on less than 20 acres must be approved by the Town Council as a special use.  The property is inside Cary’s town limits. (Refer to item F.1. on this agenda, 03-SP-217, for the associated site plan.) (Approved)

H.  COMMITTEE REPORTS (discussion items)

 

1.    Planning and Development Committee, March 18, 2004 

 

a. Town Hall Campus Gateway Public Art Project (PR04-31)
Committee unanimously recommended approval of items 2-4 of staff’s recommendation and recommended forwarding items 1 and 5 to Council for discussion. 

The staff recommendations follow with the council's action noted in red:

(1)        Approve the overall design concept of “Gates of Light” presented by Catherine Widgery.  Staff and CVA will continue to work with the artist to refine the gateway component at Chapel Hill Road and Academy Street .  Such refinements will be reviewed by both CVA and the Public Art Advisory Board prior to presentation to Council. (Approved overall design of Gates of Light as presented by the artist contingent upon staying within the initial budget of $300,000 )

(2)        Authorize the etching of the design proposed by Catherine Widgery into the outside glass bridge as provided for in the Town Hall expansion plan.  This authorization would include funding with an appropriation of $15,750 from General Capital Reserve Unrestricted Fund Balance as well as the recognition of $15,750 in revenue from Cary Visual Art to fund $31,500 in contracted services within the Town Hall Gateway Project PR1079. (Approved)

(3)        Consider phased funding for other components of the project during the FY05 Capital Budget discussions. (Approved)

(4)        Direct staff to work with CVA to develop additional fundraising strategies to reduce additional Town appropriation. (Approved)

(5)        Consider opportunities for incorporating the design into other elements of the Town Center and other areas including signage opportunities. (Directed staff to consider opportunities to incorporate these design elements into other elements of the town hall campus signage to give everyone a chance to see what it will look like) 

I.   OLD/NEW BUSINESS

 

1.    Veterans Freedom Park Request for Funds (PR04-27)
The Operations Committee recommended that staff work with the Veterans Freedom Park Foundation to refine the needs of the group pertaining to the scoping of the project.
(Deferred until 4/15/04 )

 

2.    Consideration of adoption of annexation 04-A-02, 331.51 acres. (Approved)

 

3.    Consideration of approval of Rezoning 03-REZ-13, Forest Oaks PDD:  Application by Withers and Ravel on behalf of 15 landowners to rezone approximately 327 acres of land located in Wake and Chatham Counties near Yates Store Road between Cary Park, Amberly, and the American Tobacco Trail. (Approved, including the additional conditions that were added on 3/12/04 and with the option to use SF-8 and SF-9 for a recreational site; the two conditions recommended by the parks, recreation and cultural resources board are not included in the motion)
