Committee unanimously recommended approval of a request to enter into a reimbursement contract with Stonewater PUD for offsite water and sanitary sewer lines.

Committee unanimously recommended creating a capital project to replace the culvert under
Washington Street and appropriating $175,000 from General Fund fund balance for this project.

c. SafeLight Cary Automated Red Light Enforcement Program (EN04-024)
Committee unanimously recommended appropriation of $32,500 in FY2004 SafeLight Program revenues and operating expenses including $22,500 for a public education campaign and $10,000 for Police Department staff to review and manage citation information.  Any revenues in excess of related operational expenditures will be distributed to the Wake County School System.

1.  03-REZ-14/03-LPA-08, Ferrell Hatcher Rezoning: Application by Elam Todd, d’Ambrosi, for David Farrell and Louanne Adams, owners, to rezone property from Residential-40 to Transitional Residential Conditional Use. The proposal will allow a maximum of 80 dwelling units.  The development is limited to single-family residential, patio homes, residential related recreation, open space and greenways. The property contains approximately 28.77 acres and is located south of Morrisville Carpenter Rd. and west of Carpenter Village Planned Development District and Louis Stephens Rd. extension.

2.  03-REZ-15, Pulte High House Rezoning: Application by Elam Todd, d’Ambrosi, for Allen Hill, contract purchaser, to rezone properties from Residential-40 to Residential-8 Conditional Use. The proposal will allow a maximum of 91 dwelling units.  The development is limited to single-family detached dwellings, recreation, open space and greenways. The property contains approximately 54.76 acres and is located at the north side of High House Road, east of Weatherstone Subdivision and west of Maynard Crossing Shopping Center .

3.  Case 03-MSU-013, Panther Creek High School : The applicant, CLH Design, representing Wake County Board of Education, has requested approval of a major special use and site plan to construct a high school in Panther Creek Planned Development. The proposed School would be located north of McCrimmon Parkway (formerly known as Panther Creek Parkway ), east of the proposed 540 extension, and approximately 2,000 feet west of the intersection of NC Highway 55 and McCrimmon Parkway . The site contains 71.21 acres and was zoned Planned Employment Center Planned Unit Development (PEC PUD) at the time of site plan submittal. According to Section 8.16.3 of the Cary Unified Development Ordinance, schools are minor special use. Section 5.4.2(b) of the Unified Development Ordinance requires all minor special uses accompanied by a site plan to be processed as a major special use and approved by the Town Council. (Refer to item F.1. on this agenda for the associated site plan.)
