C. PUBLIC HEARINGS

1. This public hearing is a quasi-judicial public hearing. All parties wishing to speak for or against 03-VAR-01 must be administered an oath by the town clerk.

Variance 03-VAR-01: Request by the applicant, Mr. Al Hashemi, for approval of a variance for Northwoods Center I, II and III, a parcel in the Northwoods Planned Unit Development, from the 100 foot riparian buffer requirement of the Town’s stormwater management plan for new development (Chapter 14, Part 6 of the Unified Development Ordinance). The project is located at the intersection of N.E. Maynard Road and Reedy Creek Road.

2. 02-REZ-13 / 02-LPA-09 (Bishop’s Gate Planned Unit Development): Application by Evangelical Covenant Church for multiple property owners to rezone property from Residential-10 Conditional Use District and Residential-40 District to Residential Multi-Family-10 Planned Unit Development. The property contains 111.45 acres and is located south of McArthur Park, south and west of Giverny subdivision and east of Davis Drive.

3. 02-REZ-14: Application by Thaddeus H. and June L. Busbice, property owners, to rezone property from Residential-30 District to Residential-10 Conditional Use District. The property contains 8.75 acres and is located west of Kildaire Farm Road, north of Winderemere subdivision and south of Mill Pond Village.

4. 02-LPA-10: Application by the Cary Town Council for a land use plan amendment to the Southeast Gateway Area Plan to add new development guidelines. The amendment applies to the corridor between Cary Towne Center and the Buck Jones Road area. The amendment contains new guidelines for the transition of the frontage properties in the corridor to low intensity, non-residential uses. The guidelines cover land uses, buffers and screening, access and circulation, architectural treatment, building scale, and typical development standards.

Committee recommended establishing a focus group/task force to address questions proposed in the staff recommendation to help develop a more defined purpose. Committee directed staff to continue evaluating the process and make recommendations at the Council meeting.
Use Focus on Cary initiative to explore questions raised by staff, including focus groups and surveys; staff to report back to council after the first of the of calendar year; Mr. Ulma will lead the effort in cooperation with Ms. Moran, and Mrs. Robison will serve as council liaison

Consideration of approval of one appointment to the Sister Cities Commission, and two appointments to the Information Services Advisory Board to fill unexpired terms.
