a.   Order to Demolish and Remove Dwelling – 111 South Dixon Avenue (IP12-001)
Committee unanimously recommended adopting an ordinance ordering the demolition and removal of dwelling located at
111 South Dixon Avenue pursuant to Chapter 8, Article V of the Town of Cary Code of Ordinances entitled “Minimum Housing Standards”. Committee further recommended, if the dwelling is not demolished and removed by the property owner within 45 days of issuance of the ordinance, the Town contract for demolition and removal with a lien to be placed against the real property upon which the costs are incurred. (Approved)

 

b.   Pirate’s Cove Greenway Open Space Donation (PR12-28)
Committee unanimously recommended acceptance of a donation of 2.5 acres of land adjacent to Pirate’s Cove Greenway, subject to proof of clear title to the property. (Approved)

 

c.   Four-Party Railroad Agreement – CSX, NCDOT, Parkside and Town of Cary (EN12-067)
Committee unanimously recommended supporting the revised Parkside Town Commons Project proposal under the current the terms and conditions. Committee further recommended entering into a Four-Party Railroad Agreement with the addition of an acknowledgement by the Developer that the agreement is not entered into under duress, a covenant not to sue the Town by the developer, and an indemnification of the town by the Developer, and granting staff authority to make consistent changes and resolve minor issues that do not affect the overall intent of the proposed agreement. In addition, committee recommended authorizing staff to make related accounting entries necessary to reflect the activities detailed in the proposal. (Approved)

In accordance with N.C.G.S. 160A-383, and based upon the recommendations and detailed information developed by staff and/or the Planning and Zoning Board contained in the case report, approval of these text amendments by the Cary Town Council will officially adopt the individual report as evidence that consistency with the Comprehensive Plan has been thoroughly evaluated and that these amendments are reasonable and in public interest.

1.   Land Development Ordinance Text Amendments – Round 23
Committee unanimously recommended that staff draft language about screening and location of clothing drop-off stations that allows accessibility without being visible from major thoroughfares and that a public hearing date be set for June 28, 2012, for the proposed Land Development Ordinance text amendment items. Committee further recommended that full council consider the topic of temporary modular classrooms as the principal use of the property. (Approved public hearing for screening and location of clothing drop-off stations; did not approve moving forward with temporary modular classrooms)
