OPERATIONS COMMITTEE

RECOMMENDATIONS

April 5, 2012

 

Committee chair Jennifer Robinson called the meeting to order at 5:30 p.m. Committee members Jack Smith and Lori Bush were present. The meeting adjourned at 5:39 p.m.

 

Consent

 

1.       Rectangular Rapid Flashing Beacon Installation Funding (EN12-056)
Committee unanimously recommended transferring $14,000 of remaining unrestricted revenue available within capital project PR1098 (Morris Branch Greenway Underpass) to capital project PR1133 (Park and Greenway Renovation) to be added to the construction expenditure account to fully fund the anticipated project work of $164,000.

2.       Cary Depot – CSX Lease Agreement (EN12-060)
Committee unanimously recommended entering into a lease agreement with
CSX Transportation, Inc. and granting staff the authority to revise minor issues with the exhibit prior to execution provided they do not affect the overall intent of the proposed agreement. If approved by Council, a forthcoming final agreement will be routed for execution.

3.       Fire Station No. 8 – Progress Energy Carolinas, Inc. Request for Utility Easement across Town-owned Property (EN12-061)
Committee unanimously recommended approving and executing a Progress Energy easement, and granting staff the authority to resolve minor issues with the easement prior to execution provided they do not affect the overall intent of the proposed agreement. If approved by Council, a forthcoming final easement agreement will be routed for execution.

4.       Amendments to Traffic Schedule 8: Prohibited Parking – All Times (PD12-013)
Committee unanimously recommended approving proposed amendments to Traffic Schedule 8: Prohibited Parking – All Times.

5.       Resolution in Support of Trap-Neuter-Return Programs (PD12-014)
Committee unanimously recommended adopting a resolution in support of privately managed Trap-Neuter-Return (
TNR) Programs in the Town of Cary.

6.       Proposed Amendment to the Code of Ordinances Regarding Tethering of Dogs (PD12-015)
Committee unanimously recommended adopting proposed amendments to Chapter 6 of the Town of Cary Code of Ordinances related to the unattended tethering of dogs, effective
June 1, 2012. This ordinance would not require a public hearing prior to adoption unless Council specifically directs one be held.

7.       Amendment to Noise Ordinance (PD12-016)
Committee unanimously recommended approving a proposed amendment to the Town of Cary, NC Noise Ordinance Sec 22-106[a] [4]:  Operating Lawnmowers; Hours of operation.

8.       Appropriation of Funds to Tryon Road for NCDOT Acceptance (EN12-057)
Committee unanimously recommended appropriating $765,000 in Powell Bill fund balance within the general capital reserve fund to the ST1073 Tryon Road Widening Phase I and ST1092 Tryon Road Widening Phase II projects, with funds to be budgeted within the ST1073 and ST1092 construction account for expenditure purposes.

9.       Western Wake Regional Wastewater Management Facilities Contract 7 (EN12-058)
Committee unanimously recommended awarding Contract 7 to S. J. Louis Construction for $13,716,150. The award recommendation will be reviewed by the Western Wake Policy Advisory Committee, and it is anticipated that they will recommend award at their meeting on
March 28, 2012. The recommendation of award by Council represents a preliminary determination as to the qualifications of the bidder and no legally binding acceptance of the bid or offer occurs until the Town has executed a written agreement.

10.   Interlocal Agreement for Colvin Park Subdivision (EN12-062)
Committee unanimously recommended entering into an interlocal agreement to provide the Town of
Apex sanitary sewer service to serve the Colvin Park subdivision and granting staff the authority to revise minor issues that do not affect the overall intent of the agreement.
