Executive Summary: Staff has compiled proposed amendments to the Land Development Ordinance in response to concerns identified by the Town Council, Planning and Zoning Board, and staff. A public hearing was conducted on

Background: A summary of the proposed amendments is provided below, with a link to each proposed text change and associated background information.
Item B:
The proposed amendment would:
· provide time limits for action, and remove special use permit requirement for antennae co-location consistent with federal and state requirements, and
· reorganize Section 5.2.4 to improve clarity.

Item C: Trails and Greenways
The proposed amendment would:
· modify definitions related to pedestrian facilities to be consistent with the Standard
Specifications and Details Manual and the Parks, Recreation and Cultural Resources (PRCR) Facilities Master Plan;
· require construction of multi-use trails in lieu of standard sidewalk where indicated in the PCRC Facilities Master Plan;
· clarify that no credit towards park land dedication payment-in-lieu will be provided for multi-use trail construction; and
· clarify time limits for submittal of a deed and survey when land dedication is required.

Item D: Transportation Improvements
The proposed amendment would:
· correct a typographical error related to the amount of financial surety required for certain improvements:
· provide for alternative mitigation options at unsignalized intersections; and
· expand the methods used to determine trip generation.

Item E: Public Transit Amenities and Monument Signs
The proposed amendment would:
· specify when transit stops and shelters are required for new development;
· provide dimensional and other standards related to transit stops and the provision of amenities such as shelters, bike racks and trash cans; and
· clarify provisions related to disturbance of buffers and streetscapes to accommodate transit facilities and monument signs.

Fiscal Impact: Implementation of the recommended text changes should be absorbed by existing staff. The extent of the fiscal impact will not be known until specific ordinance requirements are implemented.
Staff Recommendation: Staff recommends approval of the proposed amendments.
