MXD Rezonings (formerly Mixed Use Sketch Plans)
MXD Rezonings (formerly Mixed Use Sketch Plans) occur when a property owner or developer wants to change the use or density of a property within an established Mixed Use Overlay District. MXD Rezonings only occur within the Mixed Use Overlay Districts and require conceptual plans to be submitted during the zoning process. These conceptual plans address the general density, mix of uses, and development patterns within a mixed use center. They are less detailed than the site and/or subdivision plans required for full site plan or subdivision review. The intent is to provide enough information to determine consistency with the Comprehensive Plan and the Town’s Design Guidelines. The MXD Rezoning process is different from other Cary rezonings in both submittal requirements and process.

Procedures
• Pre-Application Conference
A pre-application conference is required before an application is filed. Call (919) 469-4082 to schedule a meeting.
• Public Hearings
At least two public hearings are required. The Planning and Zoning Board and the Town Council hold these hearings. If further changes occur to the application, additional public hearings may be required.
• Town Council Decision
After reviewing Planning staff and Planning Board reports and recommendations, the Town Council holds a public hearing and makes a decision. A majority plus one of the council decides the MXD Rezoning.

Who May File MXD Rezoning Requests
MXD Rezoning requests may be initiated by the Town Council, Planning and Zoning Board, Zoning Board of Adjustment, any owner of a legal or equitable interest in land within Cary or its extra-territorial jurisdiction, or any resident of the town or extra-territorial jurisdiction.
