    A Notice of Class Action has been entered in the lawsuit filed by plaintiffs Brian Ceccarelli and Lori Millette, individually and as class representatives, against the Town of Cary. The lawsuit challenges the lawfulness of Cary's Red Light Camera program at certain intersections as outlined in the Notice.

    > If I've ever received a Red Light Camera citation, am I automatically a part of the class?
    No. As stated in the Notice, the Class is limited to persons assessed a civil penalty at the following intersections and times:

        - At the intersection of Cary Towne Boulevard and Convention Drive from December 2, 2009 through March 19, 2010.

        - Between August 1, 2012 through August 18, 2012 while making a left turn maneuver at the following intersections:

            a. Traveling westbound on Maynard Road and turning left on Kildaire Farm Road;
            b. Traveling westbound on Cary Parkway and turinng left onto Kildaire Farm Road;
            c. Traveling northbound on Kildaire Farm Road and turning left onto Cary Parkway;
            d. Traveling northbound on Cary Parkway and turing left onto High House Road;
            e. Travling southbound on Walnut Street and turning left onto Meeting Street.

    > How do I join the lawsuit?
    As stated in the Notice, if you are a person described in the Notice of Class Action, you are included in the class. You do not need to respond to the Notice.

    > What if I don't want to be a part of the lawsuit?
    The Notice of Class Action includes information about your right to exclude yourself from the lawsuit. You may also contact Class Counsel at (919) 362-8873 or paulstam@bellsouth.net.

    > Does this mean the Town is refunding the cost of my paid citation?
    No. Plaintiffs in the lawsuit are seeking to obtain refunds for class members, however, a final ruling has not been issued in this lawsuit. Please ocntact Class Counsel at (919) 362-8873 for more information.
