TEEN DRIVER CHARGED IN FATAL CRASH  

CARY, NC – The driver of a car in which two teens died on Monday has been charged with two counts of misdemeanor Death by Motor Vehicle.  Katherine Hart, 16, of 103 Dundalk Way in Cary was charged based on her failure to yield right of way and exceeding the regulations of her graduated driver’s license, which limits her to one passenger in the vehicle when a parent or guardian is not with her.  

Hart’s first appearance is scheduled for June 15, 2004 at 2 p.m. in Wake County District Court.  The Class One misdemeanor carries a maximum penalty of a one year driver’s license revocation, up to 120 days in jail, fines, and court costs.  Restitution to the family can also be ordered by the court.  

The accident occurred around 4:30 p.m. on April 12, 2004 in the eastbound lane of US 64 in southern Cary .  Hart was attempting to turn south onto Mackenan Drive when her car was stuck by a tanker truck carrying liquid nitrogen.   

Breann Nicole Gentz, 16, of 1217 Bungalow Park Drive in Apex, NC and Kassel Aaron Smit, 16, of 103 Tasman Court in Cary , NC died at the scene.  They were passengers in the 1994 Plymouth Acclaim being driven by Hart.  The driver of the tanker, Dwight Gilmore, 40, of 905 North Weldon Street in Gastonia , NC was not injured.
